Brazil’s Supreme Federal Court has plunged deeper into an institutional crisis as two of its prominent justices requested major sanctions against each other, threatening to upend the judiciary’s role as an arbiter in the nation’s most contentious political fights.
The Clash Between Justices de Moraes and Mendonça
The escalating feud centers on Justice Alexandre de Moraes, who oversaw the high-profile case that convicted former President Jair Bolsonaro, and Justice André Mendonça, a Bolsonaro appointee. The dispute erupted after Mendonça released a report detailing alleged links between de Moraes and disgraced banker Daniel Vorcaro, who faces accusations tied to a wide-reaching fraud scheme.
In response, de Moraes accused Mendonça of abusing his authority by unsealing the sensitive documents. The collision has exposed deep fractures within the nation’s highest court during an already volatile political cycle.
An Urgent Legal Reckoning for the Court
Chief Justice Edson Fachin announced that he would give Brazil’s attorney general five days to weigh the allegations brought against Mendonça. Meanwhile, the court is scheduled to decide whether to formally investigate de Moraes.
Felipe Recondo, a journalist, researcher, and longtime observer of the court, described the moment as potentially "the most dramatic moment in the history of Brazil’s Supreme Federal Court." Recondo warned that the court has historically acted as an intermediary in Brazil’s fiercest political battles, noting, "Remove the court from that position, and all that remains is conflict. And that is a problem."
Bolsonaro’s Conviction and International Backlash
The right wing of Brazilian politics has seized upon the allegations against de Moraes to cast doubt on the legal proceedings against Bolsonaro. The former president is currently under house arrest after receiving a 27-year prison sentence for his involvement in a coup plot. Appointed to the Supreme Court under former President Michel Temer, a centre-right politician, de Moraes has frequently drawn the ire of Brazil’s far-right due to his central role in sensitive political investigations.
Prosecutors established that following his election loss to current President Luiz Inácio Lula da Silva in 2022, Bolsonaro and his far-right allies sought to subvert election results and disrupt the transition of power. Those post-election tensions culminated in an attack by Bolsonaro supporters on key government buildings in Brasília on January 8, 2023, allegedly intended to trigger a military uprising. Federal police subsequently recommended charges against Bolsonaro and key allies in November 2024.
Bolsonaro has consistently characterized the prosecution as a political "witch hunt" orchestrated by the left. His defense has drawn international attention, including support from United States President Donald Trump. Trump’s Treasury Department briefly sanctioned de Moraes over his handling of the Bolsonaro trial, as well as his suspensions of online platforms such as Rumble and X.
The Vorcaro Scandal and the October Election
The unsealed documents concerning banker Daniel Vorcaro suggest he may have sought advice from de Moraes, further threatening the court’s reputation. The revelations have prompted various politicians to demand clarity on the relationship, with some calling directly for de Moraes to resign.
The timing of the scandal coincides with a contentious presidential election scheduled for October 4. The race pits left-wing Lula against Senator Flávio Bolsonaro, the eldest son of the former president. Candidates across the political spectrum have sought to paint their opponents as corrupt. Senator Bolsonaro has capitalized on the Supreme Court dispute, framing it as a conspiracy between de Moraes and the political left.
“Out with Lula! Out with Moraes! This duo has no place left in leading the Country,” Senator Bolsonaro posted on social media. “It’s time for change! Brazil will win!”
At the same time, the younger Bolsonaro has faced scrutiny over his own reported connections to Vorcaro. Earlier in the year, the US investigative news website The Intercept Brasil published messages indicating that Senator Flávio Bolsonaro had petitioned Vorcaro for funding.
With the attorney general’s review window underway and the full court set to vote on whether to launch an inquiry into de Moraes, the Supreme Court faces a crucial institutional threshold ahead of the October election.
