The former governor of Tamaulipas, Francisco Garcia Cabeza de Vacaobtained an injunction against the arrest warrant issued by the Attorney General of the Republic (FGR); there is also one migration alert issued by the Ministry of the Interior through the National Migration Institute (INM) to prevent escape or subtraction of justice.

The arrest warrant was issued on October 4, for alleged responsibility in organized crime offenses and operations with resources of illicit origin.

The amparo filed against the arrest warrant issued by the Specialized District Judge in the Accusatory Penal System of the Justice Center Criminal in the State of Mexico, with residence in the municipality of Almoloya de Juárez and other authorities, was granted by the Judge of the Eighth District of Tamaulipas, Faustino Gutiérrez Pérez.

The same judge that in the past granted the same measure for the suspension of their bank accounts and the previous arrest warrant.

The file of the new amparo is under the number 2477/2022 in the council of the Federal Judiciarywhere it is established that the federal judge, Gregorio Salazar Hernández, who issued the new arrest warrant, has a period of 48 hours to render his report in writing.

Judge hits García Cabeza de Vaca; can be arrested for organized crime

“The provisional suspension is granted to (Francisco Javier García Cabeza de Vaca), in accordance with articles 138, 162, 163 and 166 of the Amparo Law, to the effect that if the crime for which the claimed arrest was made does not require informal pre-trial detention, things are kept in the state they are currently in, and they are not deprived of their personal liberty until the final suspension is resolved.

“In the event that the offense does require informal pre-trial detention, the provisional suspension requested is granted for the sole purpose that once the claimed act (arrest order) is executed, the applicant for protection remains at the disposal of this District Court. in the place where he is detained, as far as his personal freedom is concerned,” explains the agreement published in court this Friday.
