That’s what it’s about

  • At a company in the canton of Bern, an employee had installed a camera.

  • The company secretary found the camera and the employee was fired without notice.

  • “It was an incredibly hurtful invasion of privacy. It took me months to get over it,” she says.

  • The man now has to pay CHF 1,400 because of this and also because of prohibited pornographic depictions.

Lorena A.* was shocked when she found a camera in the toilet at her workplace in the canton of Bern in June 2022. “I noticed the red light,” she says to 20 minutes. The camera was installed with adhesive tape on the back of the washbasin furniture, according to a penal order from the Bern public prosecutor’s office, which is available 20 minutes. It was aimed directly at the toilet and took pictures of the people using the toilet.

When she realized what she had just found, Lorena A. wanted to march straight to her boss. On the way there she met Frédéric G.* What she didn’t know was that he had installed the camera. He may have seen that A. had found the camera and was now trying to destroy evidence.

“Of course I told him what happened,” says Lorena A. “I was good with him. And I was shocked by my find.”

“Never in my life would I have thought that he was capable of something like this”

Frédéric G. had only worked for the company for six months. “He made a serious impression,” says his former boss and company owner Marcel K*. ‘He was pleasant, kind and decent. Never in my life would I have thought that he was capable of something like that.”

When he found out what happened, Marcel K.* immediately called a meeting: “I said: I want to know who that was. You have until tomorrow noon.” Then Frédéric G. confessed to having installed the camera. “He claimed it was a spontaneous idea and asked if he could continue working – he will certainly never do it again,” says Marcel K. “Of course we fired him without notice and reported him. You can’t look someone in the eye after something like that.”

After the report, the police will take action. What she finds out is in the penalty order: The camera was installed on June 25, 2022 during the lunch break – four days before it was discovered. The company has only one toilet, which is also used by customers.

Found underage pornography

In addition, during a house search, the officers found forbidden images on Frédéric G.’s cell phone: sexual acts with animals and acts of violence, as well as actual sexual acts with minors. Now he has been convicted of violating secret or private areas with recording devices, of pornography and of violating the Narcotics Act.

He receives a conditional fine of 45 daily rates of 90 francs each (total 4050 francs) with a probationary period of two years. He only has to pay 1,400 francs – a liaison fine of 700 francs, a fine of 200 francs and the procedural costs of 500 francs.

“I have no words for what happened”

Not a big fine, as his former boss thinks: “He got away with it pretty easily,” says Marcel K. “I’ve definitely become more careful since then. I pay more attention to any hidden cameras – and I’m more suspicious when hiring people.”

“I have no words for what happened,” says Lorena A. “I was in shock, it was an incredibly hurtful invasion of privacy. It took me months to get over this. I have more trouble trusting people I meet now.”
