The Munich I public prosecutor’s office has accused Thomas Pekny “of repeatedly accessing child and youth pornographic content,” as the authority announced on request.
The trial at the Munich District Court has not yet been scheduled. Pekny’s lawyer Florian Zenger did not want to comment on the indictment and the allegations against his client when asked by the German Press Agency. It is the presumption of innocence.
As the public prosecutor’s office further announced, a penalty order against the native of Linz for sexual harassment has now become final. Further investigations into suspected sexual abuse of people unable to resist were dropped.
Pekny, for whom the presumption of innocence applies until the new trial is completed, was acquitted of the allegation of serious sexual abuse at the end of July 2021. In its judgment, the Munich I Regional Court came to the conclusion that no evidence could be provided. Pekny had strictly rejected the allegations in the process.
The starting point for the investigations at the time were numerous photographs of naked women. The photos had been found at Pekny’s. The testimony of an affected woman was rated as very credible by the court. However, since she had no recollections of the period of the accused acts and some time before and after, the court could not rule out that – as alleged by Pekny – she had given her consent.
First judgment final
Since the public prosecutor’s office withdrew its revision in the process, the acquittal for the ex-director is now also final.
The head of the theater resigned from his post after the trial, but is still working as a stage designer for the house, according to the comedy’s website, also for current productions.
“I deeply regret that the events of five years ago made people, in a high-spirited mood, feel that they had been affected,” he said when he retired as director. He didn’t want to take advantage of anyone. “The events affected me so much that in the future I will certainly be much more sensitive to situations that people around me might find stressful.”
