Salty penalty for those who employed Chinese labor on the black market

A Chinese restaurant manager was sentenced on Tuesday for employing foreigners without authorization. This repeat offender escaped prison but not a heavy financial penalty.

Already convicted in the past for employment of foreigners without authorization, the manager of a chain of Chinese restaurants, in Chablais and in the Lausanne suburbs, had to answer for his actions before the District Court of Lausanne on Tuesday. Convicted again for employing undeclared Chinese labour, the restaurateur, also Chinese, was sentenced to a financial penalty of 150 day fines to 200 francs.

“My client operated three restaurants (note: one of which he still operates) with his company and he delegated the tasks poorly. He admits he was wrong. But the people hired on the trial were hired by two practitioners, holders of the restaurant license, ”says Me Pierre Ventura, lawyer for the defendant. Referred separately, they received pecuniary sentences, but lighter, reports the lawyer.

He can still exercise

For his part, the accused is still a director of the company which operates another restaurant in Vaud, and in which he also officiates as a cook. “He now has total control. I have good hope that it will no longer be false, ”says Me Pierre Ventura. Having been able to avoid prison for his client, he will not appeal.

But taking into account his background since 2013, the Public Prosecutor estimated that “only a prison sentence of 4 months would prevent the accused from committing new offenses”. The restaurateur, denounced by the Directorate General for Employment and the Labor Market, had already been sentenced to prison in 2020 and had been granted conditional release. For the facts judged on Tuesday, the prosecutor Jonathan Cornu also intended to impose 60 day-fines of 100 francs on him. The latter awaits the reasoned judgment to rule on a possible appeal.

Closed by order of the cantonal trade police, the two restaurants of the chain have a new manager. They were able to reopen a few months ago.
