Congo Republic Imposes 18% VAT on Foreign Digital Services Providers

The Republic of Congo has enforced an 18% value-added tax on foreign digital service providers lacking a local establishment, targeting cross-border platforms ranging from Google to streaming and gaming services, according to recent materials published by KPMG.

Foreign Firms Face Compulsory Value-Added Tax Registration

  • Foreign companies providing online ads, games, streaming, software, and cloud storage to Congolese customers must register and pay an 18% VAT.
  • There is no minimum revenue threshold, meaning companies with minimal local sales or user counts still hold full registration duties.
  • Businesses manage compliance directly through the Post and Electronic Communications Regulation Authority (ARPCE) digital portal without requiring local bank accounts or tax agents.

Companies Must Remit Quarterly Payments in Major Currencies

The tax framework derives from the 2024 Finance Act enacted at the end of 2023, with the Congolese government establishing operational guidelines this January before enforcement began on July 1. Under this mechanism, foreign operators must file returns and remit payments quarterly in US dollars or euros. The initial filing window covering transactions between July and September closed on October 20, while the deadline for fourth-quarter activity is due on January 20. Businesses must retain transaction logs and proof of payment for a full decade.

To determine user location, the regulatory framework relies on account addresses, internet protocol (IP) addresses, device geolocation data, and payment instruments. Operators are required to archive these verification records alongside quarterly filings, which remain mandatory even during periods with zero taxable transactions. The regulation distinguishes sharply between direct sales and platform intermediation. Digital vendors selling direct-to-consumer software or games calculate the 18% levy against the total billed amount. Conversely, online platforms facilitating lodging, food delivery, or vehicle rentals apply the 18% rate exclusively to their brokerage commissions rather than the underlying transaction value.

Service Type Tax Base Calculation Applicable VAT Rate
Direct Digital Sales (Games, Streaming, Software) Total amount billed to the consumer 18%
Intermediation Platforms (Lodging, Delivery, Transport) Commission fee charged by the platform 18%

Firms Complete Reporting Duties Through the Designated Online Portal

Foreign entities must complete these reporting duties using the designated online portal operated by the regulatory authority. Successful registration grants a unique identification number utilized for all subsequent quarterly submissions. The absence of a physical footprint or a local corporate office no longer exempts major tech firms from participating in the jurisdiction’s tax ecosystem. Companies are expected to manage international wire transfers in major foreign currencies while adhering strictly to the strict ten-year data archiving mandate imposed by the regulatory authority.
