The Supreme Court of Justice rejected a request by Aníbal Lotocki to practice the profession. The controversial doctor sought to annul the ruling that temporarily prevents him from working while his sentence is reviewed.
The Oral Criminal and Correctional Court No. 28 of the Federal Capital acquitted Lotocki of the crime of fraud and sentenced him to four years in prison and five years of special disqualification from practicing medicine.

The doctor’s defense filed an extraordinary appeal against that decision, declaring it inadmissible. However, the Supreme Court, with the signature of Horacio Rosatti, Carlos Rosenkrantz, Juan Carlos Maqueda and Ricardo Lorenzetti, rejected the claim.

They asked to bring Aníbal Lotocki to trial for the death of Cristian Zárate
Prosecutor Pablo Recchini ordered that Aníbal Lotocki go to trial for the death of Rodolfo Cristian Zárate. The businessman died in April 2021, hours after undergoing an intervention with the controversial surgeon.
For the same reason, Lotocki is currently detained in preventive detention in the Federal Penitentiary Complex No. 1 of Ezeiza, accused of Simple Homicide with possible intent.

The doctor is being investigated for the death of businessman Rodolfo Cristián Zárate that occurred on April 16, 2021 during a surgical intervention that Lotocki had performed on him to reduce fatty tissue.
At the beginning of the process, the case had been classified as manslaughter, but after the request of prosecutor Pablo Recchini, the City magistrate modified the criminal classification to simple homicide with prison sentences ranging up to 25 years in prison.

Two weeks ago, Ileana Lombardo, Aníbal Lotocki’s lawyer, spoke about the doctor’s judicial situation one day after his arrest. “It was an act of betrayal,” she denounced.
Lombardo approached the Villa Lugano warden, located in Madariaga and General Paz, where the controversial doctor was initially detained. “I came to see him, but I couldn’t. We didn’t know the schedule, we started calling on the phone and since no one answered us, we came,” explained the lawyer.

Asked about the strategy, she flatly denied the possibility of a release. “We cannot ask for it because what happened and led to the arrest is the revocation of a release that Lotocki had in the case of the deceased Zárate with a House resolution that was an act of treason.”
Regarding his complaint, he stated: “We went to a hearing in which another issue was debated, which was the denial of arrest of a request that Mr. (Raphael) Dufort had made, which Schlegel denied, and then he appealed and He appealed to the Chamber. And the Chamber did not resolve on that arrest request, but rather resolved on another case, which is that of Zárate.”
Furthermore, he pointed out that he did not have jurisdiction to do so. “I don’t know if Lotocki’s detention is illegal, but it is questionable. And we are going to challenge it, obviously.” “All this happened very quickly, because we went to the hearing and within an hour the resolution came out. We were still in a bar having coffee. Which gives us the idea that this resolution had already been made,” she remarked.
