Primary 29 Pan-Democrats plead guilty

The 47 people who initiated or participated in the pro-democracy “35+” primary election the previous year were suspected of violating the “Hong Kong National Security Law” and were charged with conspiracy to subvert state power. As the designated judge and chief magistrate of the National Security Law, Luo Quan, who handles the delivery procedure, issued an order yesterday to lift the reporting restrictions on the delivery procedure in this case, the identities of the defendants who have pleaded guilty in the procedure and the facts of the admitted case were exposed. Among the 47 people, 29 defendants, including Dai Yaoting, Huang Zhifeng and Mao Mengjing, have confessed to the charges, and they will be handed over to the High Court for sentencing. Under the current law, defendants involved in the crime of conspiracy to subvert state power can be sentenced to life imprisonment or more than 10 years in prison if the crime is the first or serious.

11 batches scheduled for High Court hearing from next month

The High Court has scheduled 11 batches of case management hearings in the High Court from September 1 to November 4 for the 29 people who have pleaded guilty (see the table for details). According to the case admitted by the 29 people, Dai Yaoting and Au Nuoxuan have published articles widely on different media and online media platforms since December 2019. Together with Au Nuoxuan and others, he organized and publicly promoted the “Pan-Democratic Camp Primary Election” with the intention of controlling the majority of seats in the Legislative Council. By indiscriminately vetoing government budgets and public expenditure bills, the government’s operations were paralyzed and the Chief Executive was subsequently His resignation triggered a bloody crackdown on Hong Kong by the central government, which in turn lobbied foreign governments to impose political and economic sanctions on Hong Kong and the mainland. They want to subvert state power and paralyze the SAR government by interfering with the daily and systematic operations of the Legislative Council. According to Dai’s proposition, one of the important steps in “spreading speculation” is to obtain 35 or more seats in the Legislative Council in order to gain an advantage in the parliamentary vote. After being elected, the defendants will not perform their duties as members of the Legislative Council, that is, they will not uphold the Basic Law, will not be loyal to the SAR government, and will not serve the SAR seriously, conscientiously, fully in accordance with the law, and with honesty and integrity.

In order to effectively control the majority of seats in the Legislative Council and prevent the occurrence of “???? votes”, Tai Yaoting, Au Nuoxuan, Zhao Jiaxian, Zhong Jinlin and Wu Zhengheng jointly organized and publicly promoted the “Pan-Democratic Camp Primary Election”. In the primary election, polling stations will be set up in various districts in Hong Kong, and paper and electronic voting will be held to understand the support rate of candidates. For coordination purposes, candidates in the primary election must promise to stand for election if they obtain the highest number of votes in their constituency or constituency, otherwise they cannot. If any Legislative Council candidate is disqualified, the “Plan B” candidate will be the top candidate. On this basis and under the coordination of Tai Yaoting, the defendants participating in the primary election reached a consensus, including submitting the nomination form for the primary election, paying a deposit of HK$10,000 each, and signing a statement confirming “agree and support the coordination meeting led by Tai Yaoting and Au Nuoxuan. The consensus reached, including the “Democratic 35+ Referendum Plan” and its goals.” Some defendants signed another agreement, admitting to veto the budget and forcing the chief executive to respond to five major demands.

Dai Yaoting, Au Nuoxuan, Zhao Jiaxian, Zhong Jinlin and Wu Zhengheng did not participate in the primary election, but Dai, Qu, and Zhao organized 6 election forums. The rest of the defendants participated in the primary election, and none of them planned to withdraw after the “Hong Kong National Security Law” came into effect, and used the primary election as a platform to publicize their subversive plans. Democracy Dynamics and the Hong Kong Institute of Public Opinion were entrusted to implement and assist with the logistics and arrangements related to the primary election. Dai Yaoting has published several articles promoting his plan in Apple Daily. Wu Zhengheng also launched the “three votes and three no votes” campaign, and urge voters to vote for the winner of the primary election through online platforms and advertisements in “Apple Daily”. The primary election was held on July 11 and 12 of the previous year, with more than 600,000 people voting at 251 polling stations. Among the 31 candidates who won the primary election, 27 were defendants in this case, and 9 of them were disqualified in the Legislative Council election; as for the 43 unsuccessful candidates in the primary election, 15 were defendants in this case, and 6 of them were named as Plan B.
