Apple is masquerading what it offers consumers as a reliable medical pulse oximeter, even though it isn’t. I truly feel with all my heart that consumers are better off without it.
Kiano noted that Apple did not request approval from the Food and Drug Administration (the “United States Anvisa”) to certify the Apple Watch as a medical device. He also inferred that on the Apple Watch, there are only two automatic measurements per day by default — compared to continuous monitoring on Masimo products.
Pulse oximetry is not useful unless it is a continuous monitor. This happens during sleep. During sleep, you may experience desaturation which may be related to apnea. You may have dangerous desaturation of pain relief from opioids you may have taken. That’s where the importance comes.
Perhaps the strangest thing about the whole story is that, in a press release issued yesterday (17/1), it was claimed that Masimo has already released a study which shows that Apple Watch pulse oximetry did not detect more than 90% of “potentially fatal events” — despite numerous scientific research that proves the opposite.
Furthermore, what is contradictory, as many may have imagined, is the fact that Masimo accuses Apple of stealing its oximeter technology and says that most of the measurements of said technology are wrong. Go figure…
According to journalist Mark Gurman (and Bloomberg), Apple denied these claims and said that Apple’s oximetry feature is “accurate” and “works great for customers and in some cases can save lives.”
Back to the interview, although Kiani said there has been no recent discussion about licensing the technology used, he stated that a deal with Apple is possible.
There are mediations ordered by the Court that I cannot delve into and that have already been carried out before. And there will likely be additional meetings in the future.
Masimo reportedly seeks up to $3 per Apple Watch as a licensing fee. Apple, however, is also suing the medical device company, claiming that the W1 watch violates several of its design patents.
The executive finally pointed out that the import ban on United States International Trade Commission could have been avoided if the Apple Watch and its components were manufactured in the United States, like those made by Masimo.
As we reported, starting today Apple began selling the Apple Watches Series 9 and Ultra 2 on its website with the pulse oximetry feature turned off by default.
