The case that the National Prosecutor’s Office continues against President Dina Boluarte for the alleged crimes of genocide and qualified homicide is delayed once again, after the office in charge of the prosecutor Patricia Benavides filed an appeal against the decision of the Power of attorney, to allow both the State Attorney’s Office and the lawyers of the victims murdered in the Ayacucho and Puno massacres to participate in the interrogations of the president.

In the document to which La República had access, it is detailed that, after the resolution of the PJ, the Public Ministry presented said request on March 14 in order to refute the decision to allow Boluarte Zegarra to be interrogated. With this, the victims’ lawyers and the PGE are authorized to participate in the rest of the proceedings scheduled by the Prosecutor’s Office, except for taking statements and interrogating.

“On March 14, 2023, this prosecutor’s office filed an appeal against the resolution of the aforementioned judiciary, which, to date, is pending resolution (the appeal),” said document announces.

Consequently, the National Prosecutor’s Office ordered “to schedule the investigative statements of those investigated in this tax file, (once it is) resolved the appeal filed by this prosecutor’s office against the resolution issued by the Supreme Court of Preparatory Investigation in the rights protection incident”, thus postponing Boluarte’s declaration until after it has been resolved.

Sources close to this medium confirmed the decision of the Public Ministry and pointed out that President Dina Boluarte cannot be summoned until this appeal is addressed. They also asserted that said entity can schedule the president again to testify without the need for the request to be seen by the PJ, “but she doesn’t.” This measure must be reviewed by the Permanent Criminal Chamber of the Supreme Court.

Meanwhile, an upcoming date for the taking of Boluarte’s statement is unknown, which, as is known, never took place for the first time, despite the fact that it was declared by the official accounts of the presidency and the Public Ministry as carried out. For their part, the defense of the victims of the protests have insisted on participating in all the procedures for taking witness statements and other procedures raised by the National Prosecutor’s Office.
