This Saturday is the deadline for employers to register employment contracts signed before October 1, 2021 in the Electronic Labor Registry (REL) on the electronic platform of the Labor Directorate. However, despite the fact that this is the term established by the Modernization Law of said service, many employers have not been able to comply with the requirement.

The reason? The intermittent operation of the platform has prevented employers from registering contracts.

“The Law says that employers must register until April 30 all employment contracts that have been signed before October 1, 2021, we have had many difficulties in our platforms, Sufficient measures were not adopted to have all the backing and technological support that allows us to record all this information”, says the director of Labor, Pablo Zenteno.

For this reason, the Directorate of Labor opened the possibility of obtaining a certificate accrediting this difficulty so that the employer is not subject to the penalties and fines provided by law.

As Zenteno explained, what the service decided was to implement a solution “that gives relief” to employers.

Thus, through a certificate of technical unavailability -which must be requested on the DT page-, it is verified that due to the failure of the platform, the term required by Law could not be met. “This is going to allow employers not to be fined, nor sanctioned, because we know that the platform has to work so that they can record this information”.

Employers will be able to access this tool until Monday, May 2.

Asked why the term was not extended to comply with this obligation, Zenteno explained that this is the term that was set forth in the Law, and to modify it, a legal change must be promoted. “We are taking all measures to solve these problems,” added the director.

To obtain the certificate, the employer must go to www.direcciondeltrabajo.cl, and there enter the MiDT platform and request it. The certificate will be delivered regardless of the number of contracts that could not be registered. Then, within a maximum period of three business days, this certificate will be sent to the email address registered by the employer with the Labor Department.
