Electrification Accident: Fighting for Recognition and Compensation

On May 14, 2022, Tom Lhuire, 19, was electrified in his bath following the fall of his charger in his bathtub. Today he is fighting for his consequences to be recognized and compensated.

Saved in extremis by his best friend, after being electrified in his bath because of the fall of his phone charger, Tom Lhuire was rushed to the University Hospital by the firefighters on May 14, 2022. Following three days of intensive care Tom complains of intense back pain and requests an x-ray to see the extent of the damage. However, “despite my pain, the doctors did not look for a bone cause to these by additional examinations” regrets the person concerned. “The emergency doctor even said to my mother: Madame, we don’t do CT scans in the wind.”

“I don’t allow my word to be questioned!”

10 days later, an X-ray of the back revealed the existence of vertebral compression in a pancake shape of his vertebrae. Tom thus lost two centimeters in size as well as 8 kilos in body mass, in addition to an imposing burn in the lower abdomen of 20 centimeters due to the electric arc.
“As my parents had taken out “life accident” insurance which covers this type of problem, I had a medical examination. The report of this expertise carried out by a doctor mandated by the insurance indicates that apart from the abdominal scarring element, I do not retain any sequel element of this electrification” indicates Tom with bitterness. Thus, according to the insurance adjuster, the vertebral fractures cannot be attributed to his accident as they were diagnosed 9 days after his discharge from the hospital. The insurance therefore refuses the compensation to which he is entitled.
“I cannot hear myself saying that this accident could not have caused these real sequelae on my vertebrae. I don’t allow my word to be questioned!”

“Today I want to publicize my situation. Not only to guarantee my rights and protect the reality of the facts, but also to raise awareness of the risk of electrification and to highlight the complex reality of the victims’ compensation process,” he asserts firmly.
Despite the presence of information on back pain in the various medical reports, the medical expert does not attribute them to his electrification. “Perhaps this is because the majority of people who have experienced a
electrification / electrocution in conditions similar to mine are no longer of this world to testify. But is it because this type of accident and sequelae have been reported very little, that mine do not exist?” he asks.
Today, in order to pursue and perhaps gain recognition of the consequences of his accident, Tom must incur significant costs to carry out a contradictory expertise, a third-party expertise or a judicial expertise involving a lawyer… “This type of recourse and its financial aspect are obviously likely to discourage these steps” concludes Tom for whom the fight has only just begun.
