European Court of Human Rights to overhaul Switzerland’s pension laws

The European Court of Human Rights has ruled that Switzerland discriminates against men in laws related to pension benefits. The court’s observations came after examining a petition filed by a Swiss citizen stating that the country shows two types of approach towards widows and widowers and this is discrimination. Women get widow’s pension till the end of their life if their husband dies. But if a widowed man has children below 18 years of age, he will get pension. Max Beeler pointed out that this is discrimination through the petition. The European Court of Human Rights also stated that the argument that it is the man who earns annuity for the family cannot be used to justify discrimination.

The court observed that such discriminations in the laws lead to reinforcing some wrong stereotypes about the duties of men and women in the society. The court also observed that the government cannot rely on the precedent that the wife’s expenses are met by the husband in a family while enacting a law.
