Faid presents the legal texts relating to economic land and public procurement

ALGIERS – The Minister of Finance, Laaziz Faid presented, on Thursday, before the Economic and Financial Affairs Commission of the Council of the Nation, a presentation on the text of the law defining the conditions and modalities for granting economic land in the domain of the State and intended for the realization of investment projects, as well as the text of law defining the general rules relating to public markets, indicates a press release from the Council.

The session was chaired by the President of the Commission, Noureddine Tadj, in the presence of the Minister for Relations with Parliament, Basma Azouar, and the Vice-President of the Senate, in charge of legislative affairs and relations with the government and the National People’s Assembly (APN), Hamoud Abdennacer.

The Minister of Finance explained that the text of the first law was part of the revision of the legal framework for investment so as to make it “more attractive”, through the law on investment promulgated on last year, which provides for a battery of facilitations aimed at improving the investment climate.

The text materializes a new “purely economic” approach in the management of economic land intended for investment, “as underlined on many occasions by the President of the Republic, to overcome bureaucracy, confer greater transparency on the processing of investment files, simplifying the procedures for granting economic land and genuinely supporting investors”, he said.

And to explain that economic land will now be the exclusive responsibility of the Algerian Investment Promotion Agency (AAPI) via its one-stop shop, in the form of an over-the-counter concession for a period of 33 years, renewable and transferable. after effective completion and commissioning of the project.

With regard to the second text of the law establishing the general rules relating to public procurement, the representative of the Government indicated that it was acting pursuant to the provisions of 139 paragraph (10) of the Constitution, aimed at the definition of the law on public procurement, raised to the level of areas governed by law, which is considered “a step towards higher levels in terms of legal standards, constituting another legal tool for the two houses of Parliament capable of creating ways and means to control management of public expenditure”.

In addition, “this progress in legal standards is supported and reinforced by a clear vision which aims to clarify the ambiguities of certain provisions complicating this article and making it a permanent source of conflicts and endless bureaucratic procedures”, added the Minister.

The Minister continued his presentation by explaining that the objective of this text of law was to simplify the field of public procurement through a clear, transparent and understandable legal framework for all, which must be respected to activate its effectiveness and ensure the desired results.

He also affirmed that the text of the law was in line with the related laws, linked in particular to performance, competition, public accounting and investment, and that this amendment to the legal arsenal aimed the national economy whose public expenditure implemented by public procurement constituted a factor of development and economic growth.

In addition, adds the Minister, “the text of the law tends, within the framework of the implementation of public demand, to encourage the use of renewable energies for the protection of the environment and sustainable development”.

The provisions of the law also provide for “a social clause considered today as one of the privileged instruments capable of making public contracts a lever to support public policies of professional integration and employment, in particular for people who have difficulty finding a job.

At the end of the minister’s presentation, the members of the committee addressed several points, welcoming the content of the text of the law relating to public procurement, being an effective tool for carrying out local development projects, highlighting the importance of legislation in public procurement, which enshrines transparency and eradicates nepotism and excesses that are eating away at the national economy.

The Committee on Economic and Financial Affairs is currently working on the preparation of its two preliminary reports, with a view to presenting them to the members of the Council, in plenary session scheduled for Monday July 17, 2023.
