Form-Plast SA Bankruptcy Leaves Bydgoszcz Workers Without Pay

Following the May bankruptcy declaration of Form-Plast SA in Bydgoszcz, employees face mounting financial hardship with unpaid wages stretching across three months. Form-Plast SA had operated in Bydgoszcz for many years, tracing its roots back to 1978 with a core focus on plastics processing, including the production of automotive components. The company’s financial troubles built up over a prolonged period. By late 2024, the enterprise filed for restructuring when its debt exceeded 49 mln zł, though attempts to reach an agreement with creditors ultimately failed.

Insolvency Proceedings and Mass Layoffs at Form-Plast SA

The legal collapse culminated on May 29, 2026, when the District Court in Bydgoszcz declared the company bankrupt and appointed a bankruptcy administrator. Just days later, on June 5, workers received formal notification of their employer’s insolvency. The workforce reductions unfolded in stages: the Powiatowy Urząd Pracy in Bydgoszcz received its initial notification regarding planned mass layoffs on April 17, followed by a second filing on June 12, as confirmed by agency director Tomasz Zawiszewski.

Online employer review portals had previously flagged management struggles at the firm, with former staff logging complaints about unpaid overtime and mandatory weekend shifts without pay. Even as late as August 11, a former worker posted a cynical note online about awaiting pay for May. While the broader workforce navigates sudden joblessness, data from the Bydgoszcz employment office shows that nine former employees of the failed company are currently registered as unemployed.

Unpaid Wages Leave Production Staff in Financial Distress

The loss of employment triggered an immediate cash-flow crisis for the rank-and-file. A former employee explained that the majority of the crew spent the month of June on overdue leave or mandatory downtime. Unfortunately, nobody received compensation for that period, leaving staff facing severe financial arrears for May, June, and July.

Workers reported receiving no concrete timeline regarding when their wages would finally hit their bank accounts. Although the bankruptcy administrator initially indicated that administrative procedures tied to the guaranteed employee benefits fund would take several weeks, nearly two months elapsed without payout. This delay has placed production personnel in a precarious financial bind.

Asset Valuation and the Waiting Game for State Guarantee Funds

Bankruptcy administrator Arkadiusz Wiśniewski from the Szulc&Wiśniewski law firm outlined the administrative steps currently underway. The insolvency proceedings sit at the asset valuation stage, after which an inventory will be compiled, filed in the case records, and published on the Public Portal of the National Register of Debtors. Once liquidation of the bankruptcy estate begins, proceeds will go toward satisfying creditors, with wage claims holding a legally privileged position.

To secure back pay for the staff, Wiśniewski submitted a schedule of unsatisfied employee claims—along with a supplementary schedule for liabilities arising after the bankruptcy declaration—to the Voivodeship Labor Office in Toruń, which operates under the state’s Guaranteed Employee Benefits Fund.

The immediate next step to watch involves administrative approval. Wiśniewski confirmed that the administrator currently awaits a payout decision from the fund and the transfer of requested funds directly into the bankruptcy estate’s bank account, which will allow for immediate disbursement to the former workers.
