The Fourth Guarantee Court determined to apply the precautionary measure of preventive detention against the former director general of the PDI, Sergio Muñoz, accused of delivering confidential information to lawyer Luis Hermosilla.

As reported by Radio Cooperativa, Judge Francis Fell assured that the most burdensome precautionary measure is “indispensable for the success of the investigation” and that “it is proportional and necessary, due to danger to the security of society and to the success of the investigations.” investigative proceedings.”

Fell specified that “the mere fact of having testified before the Public Ministry cannot be considered equivalent to substantial collaboration in clarifying the facts,” adding that Muñoz’s statement “seems to have been made with the effect of avoiding a burdensome precautionary measure.”

“Regarding the crimes of violation of secrecy, we are in the presence of serious facts, in which we seek to prevent acts of corruption by public officials,” he added.

Muñoz’s defense sought to have the precautionary measure carried out at his home, but the judge determined that he must do so at the PDI Tactical Reaction Brigade in Cerrillos.

The Public Ministry pointed out that among the leaks are the cases of Espinosa (former director of the institution), Dominga, Enjoy, Torrealba and Guevara, and that Muñoz began to provide sensitive information four days after taking office in 2021.

Pamela Valdés, spokesperson for the Eastern Prosecutor’s Office, said that “we are very satisfied with the work carried out in a few months (…) in which serious facts that compromise the trust of the institutions could be proven.”

“We want to be emphatic in pointing out that criminal responsibility is individual. We have excellent work with the PDI officials and this cannot muddy these relations, and that is why this resolution is so important and fundamental,” he added.
