French Court Orders Husband to Pay Community 81,000 Euros

When spouses marry under the default French legal regime of “community of acquests,” rental income generated by one partner’s personal property is not automatically private wealth. A recent ruling confirms that using such income to pay down a personal mortgage requires financial compensation to the marital community upon divorce.

Courts Calculate Compensation Using Current Market Value

  • The Asset Trap: Rental income from an apartment owned by one spouse before marriage is legally considered common property, not personal income.
  • The Compensation Requirement: Using these “common” rents to pay off a “personal” debt creates a financial imbalance that must be rectified through a “reward” (récompense) paid to the community.
  • The Valuation Method: Courts calculate this debt based on the current market value of the property, including any capital appreciation, rather than the original purchase price.

The Montpellier Court Ruling on Rental Income

In a case involving a couple married in 2008 without a prenuptial agreement, the Montpellier Court of Appeal addressed the intersection of personal debt and community assets. The husband, identified as M.X, owned an apartment prior to the marriage. Between 2008 and 2015, he directed approximately 33,600 euros in rental income from this property toward his personal mortgage repayments. Upon the couple’s divorce, his spouse, Mme Y, sought a legal “reward”—a compensatory payment to the marital community—arguing that the rental income was legally communal.

The court ruled in favor of Mme Y, ordering M.X to pay 81,000 euros. This figure was derived from a calculation of the community’s contribution to the property’s capital. Because 55% of the mortgage was paid using communal funds, the court applied that percentage to the apartment’s current appreciated value of 148,000 euros, rather than the initial purchase price. This follows the legal principle that the compensation due to the community “cannot be less than the existing profit” derived from the investment.

Legal Interpretations of Consumed Assets

M.X attempted to contest the ruling by invoking Article 1403 of the French Civil Code, which states that the community is only entitled to “fruits received and not consumed.” He argued that because the rental income was immediately diverted to mortgage payments, the funds were “consumed” and therefore no longer existed as assets. However, the court and legal doctrine rejected this definition.

According to the case instructions, “consumption” in this legal context implies an expenditure that leaves nothing behind. Because the rent payments were used to amortize the capital of a property, they left behind a tangible, subsisting investment. Consequently, the courts determined that the funds were not consumed, but rather reinvested into a personal asset at the expense of the marital community.

Factor Legal Determination
Rent Status Common property (Community of Acquests)
Investment Source Communal funds (55% of mortgage)
Valuation Basis Current market value (148,000 euros)
Legal Precedent Articles 1401 and 1437 of the Civil Code

Contraindications & When to Consult a Legal Professional

This ruling highlights the significant risks for individuals who manage personal real estate portfolios while married under a default community regime. Those who do not have a formal marriage contract (séparation de biens) are at risk of losing equity if they commingle rental income with personal debt service.

The Ongoing Debate on Marital Assets

While the Montpellier ruling clarifies the treatment of rental income, the case is currently moving toward the Court of Cassation.
