The Karnataka government has told the high court that it is not prohibited in India to wear the hijab with restrictions subject to institutional discipline. Karnataka Advocate General Prabhuling Nawadgi argued that the right to wear the hijab did not fall within the ambit of Article 25 of the Constitution.
The right to wear the hijab falls under Article 19 (1) (a), not Article 25. “If a person wants to wear the hijab, there is no restriction ‘subject to institutional discipline’,” Nawadgi told the Karnataka High Court.
In this case, the wearing of the hijab inside educational institutions is restricted. It is not forbidden to wear hijab anywhere else. The Advocate General argued that wearing the hijab was a fundamental part of the religion, and that it had a coercive nature, giving the impression that those who did not wear it were out of the community.
