A forty-year-old from Arlon appeared before the appeal court sitting with three judges to answer for two cases in which he is accused of having used a car with a high blood alcohol level. Son of a retired police officer, the defendant explained the positive developments in his situation. “I have a major problem with alcohol,” he admits. “But I have just been hospitalized for six weeks in Malmédy at the Center des Hautes-Fagnes. I am much better.”
The defendant is immediately interrupted by Yannick Rosart, the deputy of the king’s prosecutor: “What happened on June 24 in Arlon, a few days after your release from the Center?” The man from Arlon blushes and stammers out an incomprehensible response. The representative of the public prosecutor’s office responds for him: “You had barely left your detoxification treatment when you were again checked for advanced intoxication.”
Mr. Marc Kauten, the defense lawyer, stands up, green with anger, angry with his client, and thunders in his stentorian voice: “I am not aware. I would have liked my client to keep me informed of this new episode before I begin my argument.”

The lawyer still pleaded, telling the story of a man who found himself in a difficult situation after losing his job in the Grand Duchy while facing a significant alcoholism problem.
The public prosecutor does not see it that way. “He accumulates and accumulates convictions, notes Yannick Rosart. Whether in 2021, 2022 or 2023, each time he has convictions for lack of insurance, lack of license and very excessive blood alcohol level. He is sixteen convictions on his criminal record.”
The Court chaired by Philippe Nazé will deliver its judgment on November 15.
