A district judge granted the Financial Intelligence Unit (UIF) a provisional suspension, which stops Juan Collado Mocelo from being handed the agreement not to exercise criminal action issued by the delegation of the Attorney General of the Republic (FGR) in Querétaro, related to the Caja Libertad case.

For the defense, this document would allow Juan Collado to obtain freedom in the criminal proceedings that were initiated against him for crimes of organized crime and operations with resources of illegal origin.

The ruling was given after a collegiate court in criminal matters revoked the ruling of the district judge, who last June dismissed the amparo lawsuit promoted by the FIU to prevent the delivery of the test data with which Collado Mocelo seeks to stay on freedom.

The justice administrator scheduled the incidental hearing for August 22 where he will decide whether to indefinitely stop the delivery of said evidence or order a transfer to the defense.

The UIF processed the lawsuit on June 9 to challenge the ruling of June 7 in which the appeal for revocation was declared unfounded, in which the FGR and the unit were required to run within five business days transfer to the private defender of Juan Collado the evidence consisting of the ministerial determination not to exercise criminal action.

In February of this year, the head of the FGR’s seventh Querétaro investigative agency, Fernando Ramos López, ordered the non-exercise of criminal action in favor of Juan Collado, due to the fact that the acquisition of the Caja Libertad headquarters building that was carried out in March 2015 for 156 million pesos was legal and not simulated as authorities claim.
