Judge drops DoJ case against Apple in the US due to conflict of interest

The huge antitrust case of United States Department of Justice (Department of Justiceor DoJ) against Apple will be supervised by a new judge, according to information from Reuters.

More precisely, the district judge Michael E. Farbiarz had to withdraw from the case based on conflict of interest. He did not define exactly what the conflict in question was, but this is usually due to close association with one of those involved in the case.

Farbiarz’s disqualification is mandatory and “cannot be forwarded by the parties” — that is, it occurred without any request from Apple or the DoJ. The judge Julien Xavier Nealsappointed by the President of the United States Joe Biden in 2021, will preside over the case now.

Both justices likely have similar views since they were appointed by the American president. The case is being pursued in New Jersey, where several other similar imbroglios have been filed and transferred to Neals.

Both Apple and the DoJ have not commented (yet) on the change.
