The Superior Court of Justice of the Basque Country (TSJPV) has issued the fourth annulment sentence of the General Urban Planning Plan (PGOU) of the Guipuzcoan town of Hondarribia, as reported by Abotsanitz. In a statement collected by Europa Press, Abotsanitz has indicated that, according to this ruling of the second section of the Contentious Administrative Chamber of the TSJPV, “the omission of the telecommunications report determines the nullity of the PGOU”. This fourth annulment sentence responds to the appeal presented by the company Jaizkibel SA.
Abotsanitz has indicated that, according to the court ruling, “it makes no sense that a general plan can be understood to be definitively approved except, as advocated by the Hondarribia City Council, of the determinations on telecommunications matters, and the unquestionable incidence that the network Telecommunications has in other areas of the approach, to the point that some of these may be conditioned by that, it prevents considering that the general plans are definitively approved without having determined the deployment of that network “.
“In other words, a general plan cannot be approved without a telecommunications report, and the fact of not having presented it cancels the entire PGOU,” he adds. Abotsanitz has urged the municipal Department of Urbanism to “act correctly.”
