According to the legal community on the 27th, Minister Han expressed his intention to avoid when the Supreme Prosecutor’s Office recently requested disciplinary action against Commissioner Jeong to the Ministry of Justice. The Minister of Justice serves as the chairman of the Prosecution and Disciplinary Committee of the Ministry of Justice in accordance with the Prosecution and Disciplinary Act, but can avoid it if there are circumstances where it is difficult to expect fairness in disciplinary decisions. It is said that Minister Han did not even receive reports related to Commissioner Jeong.
Earlier, the Supreme Prosecutor’s Office recently requested disciplinary action against Commissioner Jeong in relation to the self-directed assault case to the Ministry of Justice. The self-directed assault case took place in July 2020, when Commissioner Jeong was the head of the 1st Criminal Division of the Seoul Central District Prosecutor’s Office, while confiscating and searching the mobile phone of a minister involved in the’Channel A attempted coercion case’. At the time, Commissioner Jeong was handed over to trial for pushing a minister and causing injury for three weeks before treatment.
Commissioner Chung was eventually confirmed innocent by the Supreme Court in November last year. However, the Supreme Prosecutor’s Office believes that Commissioner Jeong violated his duties as a prosecutor in the process of confiscating and searching a minister’s mobile phone.
When the fact of the Supreme Prosecutors’ Office’s request for disciplinary action became known, it was pointed out that it was a ‘retaliatory discipline’ centering on the political world. This is because it is inappropriate to belatedly punish a case in which the Supreme Court has confirmed its innocence. However, it is known that the Supreme Prosecutor’s Office is in a position that the reason for the disciplinary action is recognized as there was a view that Commissioner Jeong’s actions were inappropriate during the trial.
