The last to approach were the sister and mother of Blas Cinalli (María Paula Cinalli) and mother of Máximo Thomsen (Rosalía Zárate). At 5:00 p.m., all the relatives had already entered the prison and, as usual since the first visit, they brought bags with food and water cans. None made statements to the press that was there.

The defendants received their relatives in the prison located ten blocks from the courts during every Wednesday in January from 5:00 p.m. to 7:00 p.m.a special schedule agreed between the Buenos Aires Penitentiary Service and the Oral Criminal Court (TOC) No. 1.

The only two days where families were unable to get close to Dolores were January 18 and 25. In the first case, access to the prison was prevented due to the call in support of Fernando’s parents for the third anniversary of the crime. The following week, the defense arguments ended at 8:30 p.m., so visiting hours had ended.

During his confinement, the defendants also received numerous visits from Hugo Tomei, the lawyer for the eight defendants, to plan the development of the trial. The last time he appeared there was the day before the investigative statement of the majority of the rugbiers, on January 18.

The prison situation of rugbiers

For a month the defendants have been housed in Unit 6 of Dolores to be close to the courts where the trial took place. The rugbiers are accused of “doubly aggravated homicide due to treachery and the premeditated collaboration of two or more people“, to the detriment of Báez Sosa, in a brutal beating that occurred in Villa Gesell on January 18, 2020 at the exit of the Le Brique bowling alley.

The eight are temporarily stopped until the process is finished on February 6, when it will be confirmed if they are sentenced to life imprisonment, in accordance with the request of the Prosecutor’s Office and the complaint, representative of the parents of Báez Sosa. The judges of TOC N°1, María Claudia Castro, Christian Ariel Rabaia and Emiliano Javier Lázzari, will be in charge of defining the verdict.

Before being lodged in Dolores, the eight implicated in the crime were in pretrial detention in the Melchor Romero prison, located in the party of La Plata. It is not yet confirmed if after a possible conviction, they will return there or if they will be transferred to another place of detention.

In the past, the defendants were detained in the Melchor Romero prison warden, in the La Plata district.

The fate of the rugby players is a matter that keeps the Buenos Aires Penitentiary Service in suspense because the eight remain isolated from the rest of the prison population fearing that they will be attacked. Even the little outdoor time they are allowed is in solitude.

The central evidence that the judges of the Báez Sosa case analyze before handing down the verdict

The defense complained that rugbiers have little time in the yard

In that line, the defense complained about the conditions of detention in Melchor Romerobecause they argued that the defendants were given little time in the yard as a result of the strict security conditions around them.

Also, during the last days of January an operation was carried out where the cell phones of Blas Cinalli and Enzo Comelli were kidnapped, as a result of an alleged misuse after interacting with Instagram social network accounts that support them. During the pandemic, they were given cell phones so that they would not lose contact with their relatives, but the use of social networks is prohibited and, upon suspicion, their equipment was withdrawn.
