Lawmakers Request UOKiK Probe Into Orlen Retail Fuel Profits

Following second-quarter financial reports, Poland’s state-controlled energy giant Orlen faces sharp political scrutiny over retail fuel margins. While the government announced a temporary value-added tax reduction and price caps starting August 17, 2026, opposition lawmakers have petitioned consumer protection authorities to investigate the company’s profits.

The disclosures prompted immediate political fallout.

Zbigniew Kuźmiuk, Member of Parliament for Law and Justice, stated via RadioMaryja.pl that despite assurances from Orlen’s management that fuel margins, particularly retail margins, had been reduced to a minimum during that time, it turned out that drivers at gas stations had been fleeced to the maximum extent possible, and therefore his caucus, the Law and Justice parliamentary group, would ask the President of UOKiK today to investigate the matter.

Government Intervention and the Return of Price Caps

Amid public and political pressure over fuel expenses, Prime Minister Donald Tusk announced during a Thursday press conference that the administration would reinstitute a significant portion of the CPN program, known as Lower Fuel Prices. The emergency measures are designed to ease financial burdens during peak travel periods, including holiday returns and the start of the school year.

The regulatory intervention reduces the value-added tax on fuels from 23 percent down to 8 percent across a strict two-week window running from August 17 through August 31, 2026. Government officials estimate the policy will lower pump prices by 90 groszy to over 1 zloty per liter. Additionally, the energy minister will publish the maximum permitted fuel price at service stations each day the program remains active.

Freight and Transport Sector Strains Under Diesel Costs

While motorists welcomed temporary relief at the pump, Poland’s commercial transport sector faced severe financial distress driven by high diesel prices. The broader Transport, Forwarding, and Logistics sector reported mounting bankruptcies after wholesale prices surged, with diesel hitting historic highs averaging 8.22 zlotys per liter following a 50 percent jump in wholesale costs.

Representatives for commercial carriers argued that the profits recorded by the petrochemical firm stemmed directly from the pressures placed on small businesses. Corporate leadership countered that global market forces dictate fuel pricing and that aggressive artificial price reductions risk creating severe shortages at service stations.

Dariusz Matulewicz, Head of the West Pomeranian Association of Road Carriers, noted via INNPoland.pl that it was already known today that the funds ORLEN boasted about in its financial results came in large part from Polish carriers, many of whom lacked the means to ensure their continued existence.

Refinery Margins and Geostrategic Advantage

While global crude oil prices climbed roughly 20 percent following conflict escalation in the Middle East, crack spreads on finished diesel jumped more than 60 percent on international exchanges. Orlen leveraged refineries located in Poland, the Czech Republic, and Lithuania to capture these international margins.

Furthermore, the corporation benefited from secure supply channels. By maintaining access to crude oil imports from Norway and via Saudi pipelines that bypass the blockaded Strait of Hormuz, the company secured feedstock while selling refined products at surging global market prices.
