In particular, as it became known, the lawsuit of Kyriakos Pierrakakis against ADEDY, whose request was to declare the strike, which ADEDY had called, as well as their decision to abstain from the evaluation of the teachers, was accepted by the Single-Member Court of First Instance of Athens (decision 227/2024).
It is recalled that the teachers of primary and secondary education had declared abstention from the evaluation procedures, as provided for in Law 4823/2021, which were then further regulated in the YA. 9950/GD5/Government Gazette B388/27-1-2023.
March 8 strike: Reannouncement of strike-abstention by IOE-OLME
Regarding this largely expected development, the ILO and OLME have decided to re-announce the strike-abstention from the individual evaluation of teachers.
The lawsuit sought to declare the teachers’ strike-abstention from the evaluation illegal and abusive, specifically:
1. To recognize that it is illegal (typically, as well as abusive) the strike declared by the defendant – abstention of primary and secondary education teachers, who are unionized by it, from any procedure or action related to the implementation of Law 4823 /21, as they were supplemented and further regulated in Ministerial Decision 9950/GD5/Government Gazette B 388/27-1-2023 “Regulation of more specific and detailed issues regarding the evaluation of teachers and members of Special Educational Staff and Special Auxiliary Staff of the primary and of secondary education as well as its implementation procedure”, as well as the provisions of the implementing circulars.
2. To prohibit the continuation of the above strike-abstention.
3. That the defendant be sentenced to – moreover and in the alternative be threatened against them – a monetary penalty of ten thousand (10,000) euros for each individual violation of the decision that will be issued,
4. That the decision that will be issued be declared temporarily enforceable, as a whole, i.e. with reference to all my above requests,
5. To order the defendant to pay the general legal costs of the Greek State.
