No, you are not reading old news: the Telegram was once again subject to a determination that could suspend courier service in Brazil. As information is from G1.

This time, the decision came from the Minister of the Federal Supreme Court (STF), Alexandre de Moraesand has the reason a message sent by messenger to subscribers of your own channel in the app about the fake news bill (PL 2630/2020), pending before the National Congress.

According to the report, Moraes requested that Telegram delete the message in question and that, moreover, the courier send a new messagealso to all its users, declaring the following:

By determination of the FEDERAL SUPREME COURT, the company Telegram communicates: The previous Telegram message characterized FLAGRANT and ILLEGAL DISINFORMATION that attacks the National Congress, the Judiciary, the Rule of Law and the Brazilian Democracy, since it fraudulently distorted the discussion and debates on the regulation of providers of social networks and private message services (PL 2630), in an attempt to induce and instigate users to coerce parliamentarians.

In the message sent to users about the Fake News PL, Telegram stated that “democracy is under attack in Brazil” and that the bill “will kill the modern internet if it is approved with the current wording”, so that companies ( like Telegram itself) may have to “stop providing services in Brazil”.

In case of non-compliance with the measures released today, Moraes determines that Telegram be suspended for 72 hours throughout the country, in addition to imposing a fine of BRL 500 thousand per hour even if the app is already offline.

Also according to the determination, the Federal Police must take testimony from Telegram representatives in Brazil within 48 hours. The messenger has not yet commented on the decision.

As we said, this is the second time that the messenger faces problems with the Brazilian Justice in less than a month – and we, of course, will continue to follow the developments of this most recent case.

Update II, by Rafael Fischman05/10/2023 at 6:45 pm

Telegram is gradually sending, to all Brazilians, a message in accordance with Moraes’ determination.

Here is a screenshot that was sent to us by the reader fabio:

She says, in full:

We received an order from the Federal Supreme Court (STF) of Brazil that forces Telegram to remove our previous message about PL 2630/2020 and send a new message to users, which is included below.

“By determination of the FEDERAL SUPREME COURT, the company Telegram communicates: The previous message from Telegram characterized FLAGRANT and ILLEGAL DISINFORMATION that attacks the National Congress, the Judiciary, the Rule of Law and the Brazilian Democracy, since, fraudulently, it distorted the discussion and the debates on the regulation of providers of social networks and private message services (PL 2630), in an attempt to induce and instigate users to coerce parliamentarians.”

The court order is theoretically fulfilled, therefore.
