Ministry of Justice in Senegal: Provisional Release of Detainees and Legal Measures

Dakar, Feb 20 (APS) – Some 344 people detained in Dakar have benefited from a provisional release measure in recent days, announced Tuesday the Minister of Justice.

During a press conference on judicial news, Me Aïssata Tall indicated that 272 detainees should also benefit from this measure in the coming days.

According to her, ”the same thing is being done” in the regions.

Me Aïssata Tall clarified that this is a case-by-case release.

A significant number of activists detained for several months on various charges linked to political activities were granted provisional release on Thursday.

The Minister of Justice recalled that the Head of State, Macky Sall, had recently committed to implementing “a pragmatic process of appeasement and reconciliation to preserve peace and consolidate the stability of the nation”.

All these people benefited from provisional release on the basis of the provisions of the procedural code, following cases studied and investigated on a case-by-case basis, by an independent and autonomous investigating judge, she explained.

”These releases are provisional freedoms. Let no one think that the adventure ends there. The courts will continue to do their duty,” she insisted.

She recalled that these people “had been detained during prohibited demonstrations causing disturbances to public order, with common law offenses imputed as the cause of their detention.”

“Therefore, I do not want in the prevailing euphoria that people see that they are done with justice,” she insisted.

According to Aissata Tall Sall, there was never any question for the State of carrying out a mass release. Files will be studied on a case-by-case basis, depending on the seriousness of the act committed or planned, and not according to the client’s mind.

According to him, “nothing that has been done so far is in contradiction with criminal law. We are just trying to calm the social and political climate in the country while respecting the law.”

“Justice in Senegal, which is the service of peace and the maintenance of public order to ensure the security of all citizens, will thus take all corrective measures to appease, while respecting the law without guilty weakness and without unnecessary cruelty”, according to the Minister of Justice.
