Namur: “the bus driver wanted to touch me”

The defendant was the bus driver who took the victims to their institution for the disabled. On January 11, 2019, after leaving his driving position, claiming that he was early, the defendant forcibly kissed a young 19-year-old woman with a mental disability, put his hand on her sex and offered to show him his genitals while asking him to remain silent about these facts. He had been harassing the victim for almost a year, according to the conveyor, touching his thighs, pulling on his briefcase or throwing him equivocal glances in the rear view mirror.

On March 4 and 8, 2019, he touched the chest of a minor aged 15 at the time of the events, who had a physical disability. He would have felt her chest “for laughs” and, during the second scene, would have pinched her breasts “for fun”.

While during the investigation he had recognized certain facts by minimizing them, the defendant denied them this Friday in court.

The father of the 19-year-old girl claims a symbolic euro, his daughter, a civil party, claims 500 €.

The Namur public prosecutor’s office is surprised that the driver, now a pensioner, continued his activity as a bus driver after the disclosure of the facts and underlines that it emerges from the psychological analysis of the defendant that a high risk of recidivism exists in its head. The forensic psychopathology unit notes a certain perversity in him, a lack of empathy and suggests psychological monitoring and a ban on seeing minors.

A three-year prison sentence is required, as is a ban on participating in activities in the presence of minors.

In view of the change in version of the defendant, his lawyer leaves the facts to the discretion of the court with regard to the facts involving the major. He pleads acquittal for those concerning the minor, believing that they are not sufficiently established.
