Ohio Prosecutors Drop Attempted Murder Charges Against Man in Toledo Festival Shooting

On Friday, October 31, 2026, Ohio prosecutors dropped all charges against a 20-year-old man who had spent five months behind bars after being accused of a mass shooting that left 12 people wounded at a historic Toledo festival.

Eljay Crisp-Carr had faced more than 50 felony charges—including 25 counts of attempted murder—stemming from the June 6 violence at Toledo’s Old West End festival. During a hearing before Lori Olender of the Lucas county court of common pleas, state prosecutors requested the dismissal without prejudice, acknowledging that newly developed evidence supported the defense.

The Collapse of a Case Built on Photographs

The sudden reversal brings a halt to a prosecution that defense attorneys argued was flawed. According to reports from WTVG, Crisp-Carr’s legal team maintained that he was not even present at the festival when gunfire erupted. Lawyers presented video and cellphone evidence intended to establish an alibi.

Speaking with WTVG after the charges against him were dropped, Crisp-Carr maintained that he had always known he was innocent and believed authorities had mistaken him for someone else. He stated that authorities had mistaken him for someone else, pointing to photographs that he believes led investigators astray. When he tried to explain the discrepancy, he recalled that officers dismissed his protests, telling him he was a monster.

His mother, April Carr, told WKYC that she felt “ecstatic” over the outcome, questioning why any mother should watch her child broadcast globally for a crime they did not commit.

Ongoing Investigation and Unanswered Questions

While the state walked back its case against Crisp-Carr, the underlying violence remains officially unsolved. The Lucas county prosecutor’s office noted in a public statement that the dismissal was without prejudice, meaning charges could theoretically be refiled if new evidence emerges. However, the office also conceded that discovery shared with Crisp-Carr’s attorney in September 2026 pointed toward his defense.

The Toledo Police Department confirmed that its investigation into the June 6 festival shooting remains active. The incident began when a dispute between rival groups escalated into an exchange of gunfire among individuals who were not among the injured victims. The violence forced organizers to cancel the second day of the annual gathering in Toledo’s historic district near Lake Erie.

Defense attorney Alex Bodiford voiced lingering concerns to WKYC, warning that the actual perpetrator remains at large and potentially armed.
