Political Trial Against Minister Alberto Pérez Dayán: Morena Deputies Take Action

The vice coordinator of the Morena deputies, Aleida Alavez, reported that they will present a political trial against Minister Alberto Pérez Dayán, because they consider that he exceeded his duties by having cast a casting vote as president of the Second Chamber of the Supreme Court and which brought down the Electrical reform promoted by the president, Andrés Manuel López Obrador.

Likewise, legislator Alavez stressed that they are going to accelerate the reforms that regulate the Supreme Court of Justice of the Nation “that cheatingly used casting vote, we are going to eliminate it.”

Ignacio Mier, coordinator of the Guinda deputies, said “there must be absolute respect between powers, which is not allowed to violate the sovereignty of one power or another, many of the laws that the Chamber of Deputies has issued through amparo have been revoked by the Judiciary, what we experienced yesterday was regrettable for the rule of law and division of powers.”

Legislators from Morena denounced as an outrage by two ministers after the setback to the electricity law, the coordinator of the Morena legislators, Ignacio Mier, expressed “yesterday they incurred a violation of their own law and a sect action with premeditation of a law that was approved in the Chamber of Deputies.”

Juan Ramiro Robledo Ruiz, president of the constitutional points, stressed that the action of the ministers implies an administrative sanction “in our opinion it implies administrative and political responsibility.”

Legislator Aleida Alavéz stressed that they feel outraged by the result of the Judiciary “deeply outraged in the legislative branch by the abuse of two ministers, in the face of a completely arbitrary action to declare unconstitutional by the full Court, 8 ministers against two, now with greater brazenness they violate their procedures and with two ministers.”

Alberto Pérez Dayán is currently minister of the Supreme Court of Justice of the Nation (SCJN). He is a lawyer from La Salle University.

Specialized in Amparo from the Pan American University and the Mexican Institute of Amparo; Constitutional and Administrative Law. He has a Master’s Degree in Law and a Doctorate in Law from the National Autonomous University of Mexico. He also has a Diploma in Anglo-American Law taught by the University of Texas, and a Judicial Specialization Course from the SCJN.

He is an academic tutor of the Graduate Studies Division of the UNAM Law School; professor at the University of Yucatán, the Federal Judiciary Institute and the Pan American University, Guadalajara Campus.

Alberto Pérez Dayán was nominated in 2012 by President Felipe Calderón Hinojosa as Minister of the Supreme Court.

Yesterday, the Second Chamber granted protection to Fuerza y ​​Energía de Norte Durango SA de CV, La Bufa Wind, Compañía de Energía Mexicana, Fuerza y ​​Energía de Hermosillo, among others, so that said reform approved during the administration of the President Andrés Manuel López Obrador.

Pérez Dayán voted in favor of the draft sentence presented by Minister Javier Laynez Potisek because he assured that “the arguments of unconstitutionality” were valid, thus rendering the electrical reform proposed by López Obrador ineffective.
