Preventive detention for Chocolate Rigau

Judge Federico Atencio issued preventive detention for Julio “Chocolate” Rigau in the case of scams and illicit association when he was caught at an ATM making money withdrawals with cards of employees of the Buenos Aires Legislature.

The request had been made by prosecutor Betina Lacki, who also requested the arrest of Facundo Albini, councilor of the Frente Renovador in La Plata; and his father Claudio, undersecretary of the Buenos Aires Legislature.

“I take into account the circumstance of being apprehended in possession of the debit cards used in the maneuver, the tickets obtained from those executed both on that date and in the previous four days, as well as, holding part of the money in fraudulently obtained cash, this occurring at the scene of the events and at the time when the last money extraction operations were carried out,” the court assessed as detailed by the Noticias Argentinas agency. For the preventive measure, the judge took into account “the expected penalty”, as well as “the number of acts perpetrated”, but also “the high amount defrauded”.

Another argument is that other possible “Chocolates” are acting simultaneously, since security camera images from previous days showed the presence of other people withdrawing money with several cards in the ATMs. “There are procedural dangers,” it was concluded when imposing preventive measures for the crime of fraud for 177 completed acts and 45 attempted ones.

Meanwhile, the La Plata Criminal Chamber has to resolve a claim for annulment presented by the defense against the police action that led to the arrest on September 9.
