Prosecutors have unsealed a grand jury indictment charging 32-year-old Nick Reiner with the December murders of his parents, actor-director Rob Reiner and Michele Singer Reiner. The new charging documents introduce a lying in wait
special circumstance, exposing him to life without parole or the death penalty.

The criminal case surrounding the deaths of Rob and Michele Reiner took a sharp legal turn Wednesday when prosecutors unsealed a murder indictment in downtown Los Angeles. Nick Reiner, 32, appeared briefly on the 13th floor of the criminal courts building as the new indictment replaced the original murder counts initially filed in 2025.
The updated filing introduces a special circumstance allegation of lying in wait, which prosecutors say changes the stakes of the prosecution significantly. The indictment also allows the state to bypass a preliminary hearing, thereby avoiding public witness testimony regarding the bloody circumstances of the crime scene and moving the case toward trial more quickly.
Inside the Brentwood Crime Scene and Early Morning Arrest
Rob Reiner, 78, and Michele Singer Reiner, 70, were found dead on December 14 in the master bedroom of their home on Chadbourne Avenue in Brentwood, situated between Sunset and San Vicente boulevards. The discovery was made on a Sunday afternoon by the couple’s 28-year-old daughter, Romy, after a massage therapist arrived for a pre-scheduled appointment and received no answer at the door. Romy entered the home, found her father’s body, and ran to a friend who called 911. Authorities subsequently located Michele Reiner’s body elsewhere inside the residence.
Investigators apprehended Nick Reiner less than six hours later in the Exposition Park area near USC. Los Angeles police arrested him following an evening where sources reported the family had attended a Christmas party hosted by Conan O’Brien. Rob and his son engaged in a heated argument at the gathering over the younger Reiner’s behavior. TMZ reported that Nick Reiner checked into a Santa Monica hotel around 4 a.m. the following morning, where blood was subsequently recovered.
Legal Strategy and the Impact of the Lying-in-Wait Charge
Legal experts note that the addition of the lying-in-wait allegation alters the defense landscape substantially. Seth J. Zuckerman, a celebrity criminal defense attorney not involved in the case, explained that the charge requires evidence of a concealed purpose and a waiting period before a surprise attack.
“The prosecution’s theory may be that he was lying in wait — concealing himself and waiting for his parents before launching the attack. If the evidence supports that theory, it could establish premeditation and support a lying-in-wait special circumstance, significantly increasing the seriousness of the charges and potentially exposing him to life without parole or, depending on the prosecution’s decision, the death penalty.”

Zuckerman added that the new charge creates a major hurdle for any potential psychiatric defense by suggesting premeditation rather than a sudden loss of control. Reiner has a documented history of battling mental health struggles and drug addiction. Father and son previously collaborated on the 2015 film Being Charlie,
which explored addiction within a privileged family dynamic. The Los Angeles County public defender’s office took over the case this year, replacing defense attorney Alan Jackson.
Prosecutorial Next Steps and Family Grief

Hochman stated, expressing hope that the grand jury indictment brings the case closer to trial and justice. Hochman previously noted that his office is looking at all aggravating and mitigating circumstances

While California maintains a governor-imposed moratorium on executions under Gov. Gavin Newsom, the special circumstance designation makes Reiner eligible for either the death penalty or life imprisonment without the possibility of parole. In June, civil attorneys for Reiner filed a petition to compel trustees to release at least $1.5 million from an independent trust fund established by his late parents to cover his legal defense expenses.
