Protecting Logos: Understanding Intellectual Property Rights and the Apple Logo Controversy

The biggest identifying mark of every company is its logo. If we see a picture of an apple cut in half, then the Apple company and the iPhone will appear in our mind. From technology companies to automobile manufacturers, all organizations grow and develop by imprinting their logo on the minds of the people.

The logo of every organization, be it global or local, is very important. Due to this importance, there are also new companies that copy the logos of successful brands. But to prevent such plagiarism there are laws called Intellectual Property Rights Act and Act.

Organizations protect their logos and names by using these legal means. But not only logos, words or names used in their products, but even those similar to them, such big companies keep registered in their name and establish rights.

Companies often do this thinking that somehow they shouldn’t have another. Apple is the company that is ahead of any other company in acquiring such trademarks. Apple’s half-cut logo is already protected as an intellectual property for trademarks.

But Apple is not ready to end there. Everything Apple looks like, whether it’s the original Apple or not, is enough for Apple to move forward. Some reports coming out now suggest that Apple doesn’t even intend to let go of the original Apple.

Fruit Union Suisse is an organization of fruit growers which is about 111 years old. The logo of this farmers’ association in Switzerland is a red apple with a white cross. The fruit growing organization created the logo by adding the white cross of the country’s flag to one of its most important crops, the apple.

Fruit Union Juice has now come forward, accusing Apple of trying to acquire the rights to their logo. The leaders of the farmers’ organization have revealed that the logo in the form of an apple cannot be allowed and Apple insists on changing it. With this, Apple’s move and trademark logo have been discussed at the international level.

Jimmy Maritos, Director of Fruit Union Juice, says their Apple logo bears no resemblance to the halved Apple logo. He also alleged that the Apple company aims to make even the real Apple their own. But for themselves, Apple is universal. He also says that their position is that it should be a right for everyone.

They know Apple will go to great lengths against anything they see as going against their trademark logo. The organization does not want to “compete” with technology giant Apple. A Swiss court ruling can sometimes take months or even years. However, he said that as an organization that has been working for more than 100 years, they have hope.

This is not the first time that Apple has come under fire against a company for choosing an image of an apple fruit as its logo. In 2020, Apple came under fire for accusing food preparation startup Prepear’s pear-looking logo of being too similar to its half-bitten apple logo. Later, the company was able to use the logo with a small change.

Citing documents from the World Intellectual Property Organization, The Wire reports that the fruit logos of several startups globally are under Apple’s watch. At the same time, it cannot be said that success has always been with Apple. In 2021, the company lost a trademark claim against the Swiss Federal Railways.

A $21 million settlement fee has also been paid. However, Apple continues to try to gain the upper hand over Apple. Figures reveal that between 2019 and 2021, Apple filed 215 trademark oppositions against the logo, name, etc.
