Seok Hyeon-jun (32), a former national soccer team member, who was sentenced to eight months in prison and two years of probation in the first trial for failing to return to Korea within the period of overseas stay permitted by the Military Manpower Administration, had his sentence commuted in the appeals court.
On the 18th, the Suwon District Court Criminal Appeal Division 2 (Presiding Judge Park Pyeong-soo) overturned the original trial at the appellate trial on charges of violating the Military Service Act and sentenced him to six months in prison and one year of probation.
The court said, “Considering the purpose of enacting the Military Service Act, the defendant must be severely punished,” but added, “However, the defendant is showing an attitude of remorse, and there are circumstances that take into account the circumstances of the crime that led to this incident.” It also ruled, “Considering that he is currently committed to military service and has no criminal history, the original trial’s sentence appears to be severe.”
Mr. Seok was handed over to trial on charges of failing to return to Korea within the designated period without justifiable grounds, despite being notified by the Military Manpower Administration to return home by June 3, 2019, while staying in the country to participate in the French soccer league. He left for France on November 12, 2018 and applied for an extension of his stay for the purpose of moving abroad in March 2019, but it was rejected and he was notified to return home.
Mr. Seok’s side stated that there was no intention, saying, “There were unavoidable circumstances in which the overseas club had no choice but to be dragged by the club because they were not properly aware of the domestic military service relationship, and my language skills were not smooth, so I had no choice but to rely on an agency.”
