Satan ignited the fire of revenge within the husband after he deluded him that his wife had squandered his dignity among his family and neighbors after she requested divorce from him, so he drew a plan for him to take revenge within the corridors of justice.
The husband prepared a white weapon, “the penknife of a gazelle’s horn,” to carry out his satanic plan of revenge, and hid it inside his clothes so that the security men would not discover it inside the family court. On the day of the accident, he went to the court headquarters, drawing on the face of the victim, so that he could reach his goal and implement his criminal scheme.
The deposed husband took advantage of his wife standing alone inside the courtroom, then took out the white weapon from among the folds of his clothes, went to her, tore her veil, then stuck his weapon in her chest, and followed it by slaughtering her from the neck so that she breathed her last inside the sanctuary of justice.
The policemen arrested the husband and the Public Prosecution referred him to criminal trial on charges of premeditated murder, so that the Minya Criminal Court issued a life sentence.
The Court of Cassation upheld the Saturday D Criminal Circuit, headed by Counselor Mohamed Reda Hussein, Vice President of the Court, and the membership of counselors Ali Hassanein, Adel Mahmoud Abdel Moneim Emara, Ahmed Abdel Latif Amin and Hisham El Gendy, Dr. Akram Bakri, Muhammad Turki, Tamer El-Gammal, Hassan Zaki, Hatem Ahmed Abdel-Bari Suleiman, Hossam Hussein El-Gizawy, and Mohamed Kamel Pasha, deputies of the court president. The ruling issued by the Minya Criminal Court to punish Ahmed A. p. Life imprisonment for killing his wife in the family court in Minya on the day set for hearing the divorce case filed against him by her.
The facts of the case are due to the fact that following the filing of the deceased victim’s wife a divorce case against her “accused” husband, and since then he determined and intended to kill her and drew his plan and prepared a white weapon, which is used to assault people, “knife” the horn of a deer, and on the day of the scheduled hearing he went to The Family Court in Bandar Al-Minya, and he stabbed her in the neck with a penknife after he took off her veil and caused her injuries that took her life.
His defense invoked the use of the husband’s right to discipline pursuant to “Article 60” of the Penal Code, but the court rejected that plea and defense by saying, “Islamic law did not give the husband the right to discipline the wife, but rather restricted this right in terms of the means, as it is not severe or disgraceful, as well as from Where the purpose of discipline is to reform the condition of the wife for a legitimate reason and not for the purpose of revenge or harm.
