Switzerland’s Decision on Digital Integrity and Constitutional Rights: What You Need to Know

Switzerland will not adopt a new fundamental right aimed at protecting the digital integrity of individuals. The National Council decided on Monday by 118 votes to 65 not to follow up on a parliamentary initiative from Samuel Bendahan (PS/VD) which proposed to include this right in the Federal Constitution. The question will nevertheless come to the forefront in the coming years.

The parliamentary initiative simply proposed adding the word digital to the constitutional article which already guarantees the right to physical and psychological integrity. For Samuel Bendahan, this new fundamental right aimed to achieve the protection of the digital life of individuals. The Committee on Political Institutions, which examined the proposal, estimated by a narrow majority (13 votes to 11) that its scope would be mainly symbolic, thus recommending that it be rejected.
