The accused beat to death the woman in the hotel with mental illness

At the time of the crime and now, the accused Xuan lost the ability to perceive, control his behavior, in the acute stage of the disease.

On January 19, Ms. Vu Thi Chin, 36 years old, living in Tan Thanh Moi hamlet, Rach Cheo commune, Phu Tan district, Ca Mau province – the sister-in-law of NTT victim said that she had just received a notice of assessment conclusions for her condition. Mental status of defendant Nguyen Van Xuan, SN 1966, living in Ward 8, Ca Mau City in the murder case occurred at a hotel on November 10, 2022.

According to the notice of examination conclusions, before November 9, 2022, defendant Xuan had no mental illness. From November 9 to November 10, 2022, defendant Xuan had a mental illness “acute multiple psychotic disorder without symptoms of schizophrenia (F23.0-ICD10)”.

“At the time of the crime and now, defendant Xuan lost the ability to perceive and control behavior, the acute stage of the disease.

Currently, the involved parties do not have enough mental health to conduct investigation, prosecution and trial activities. Defendant Xuan belongs to the case of compulsory medical treatment under Decree 64/2011/ND-CP”, the notice of examination conclusion stated.

Like Reporter brought, around 6pm on 9/11, Mr. Xuan and Mrs. T. came to rent room 301 at a hotel in Ward 5, Ca Mau City. At 8:00 am on November 10, hotel staff determined that there was a fight in room 301, there was a loud noise, so they went down to report to the front desk and reported to the police.

At the same time, Ms. T. made a phone call to the accused’s biological son to inform him that he was being beaten by Mr. Xuan. Specifically, Mr. Xuan used a wooden chair to beat Mrs. T. broke the chair, then used the legs of the chair to continue hitting the victim. Being beaten violently, Mrs. T. just opened the door to the room and ran out, but Mr. Xuan continued to beat him.

When Mr. Xuan’s son arrived at the hotel and discovered the incident, he took Mr. Xuan to leave the hotel. After that, Ms. T was taken to the hospital by her relatives with a diagnosis of multiple injuries and died on the afternoon of the same day.

Due to signs of mental crisis, the legal authorities requested a psychiatric assessment of Mr. Xuan.

However, on 11/14/2022, when taking Mr. Xuan to the Southwest Forensic Center in Can Tho City, his health condition was not eligible for psychiatric assessment. From there, the center suggested the investigation agency take him to Can Tho Central General Hospital for treatment.
