The Belgian Catholic Church and GDPR: Debaptism and Data Protection Controversy

According to the VRT the Belgian Catholic Church will have to answer before the litigation chamber of the Data Protection Authority (APD) for the conservation of the names and data of people who have been debaptized: is the Church violating European legislation on the protection of private data (GDPR) by keeping these files? The APD will examine this issue before the litigation chamber in the coming weeks, following receiving several complaints from debaptized people.

The debate around renaming recently resumed in Flanders following the broadcast by VRT de la series documentary “Godforgotten”, where victims and their families testify regarding the years during which sexual abuse was committed in the Church. Several people have decided to be renamed following watching these shows.

Even the question of whether a rebaptization is possible is doubted by the diocesan authorities, according to the VRT : there should only be a note in the baptismal register indicating that the person has “left the ecclesial community”. In De Standaard, the spokesperson for the Socialists and Democrats Group in the European Parliament Jan De Zutter denounces this practice as a violation of the GDPRwhich prohibits organizations from retaining the data of people who have expressed their “right to be forgotten”.

The diocese itself currently lacks precise information and, according to VRT, will look into this issue when the entire “Godvergeten” series has been broadcast.
