The CFDT draws a very critical assessment of the Macron ordinances on social dialogue

While they sought to improve the quality of exchanges between employees and bosses, the ordinances of September 2017 on the labor code have often had the opposite effect. This is the very severe observation made by the CFDT in an assessment made public on Friday, January 7. “The target was missed”, launched Laurent Berger, general secretary of the central cédétiste, during a press conference. Its assessments turn out to be harsher than those of the committee of experts which had also analyzed the impact of the reform, in a report released in mid-December 2021.

Emmanuel Macron’s campaign promises, the measures promulgated in September 2017 sought to strengthen “Efficiency” collective bargaining in “Simplifying” employee representation bodies. It is with this in mind that the social and economic committee (CSE) was founded: it replaced the works council, the staff representatives as well as the health, safety and working conditions committee. work (CHSCT).

For Mr. Berger, these changes have led to a “Greater centralization of social dialogue” and on a « concentration » discussion spaces. At the same time, we witnessed “A massive disappearance of local representatives”, their presence is only provided for in a quarter of the agreements that have set up CSEs, according to the CFDT. So many developments that have helped to weaken the link between the grassroots and trade unionists acting as interlocutors with the hierarchy. The ordinances granted “Blind trust in employers” to achieve the goals of the reform, “While giving them the means to escape it”, summarized Mr. Berger. In his eyes, many company directors were satisfied with the strict minimum, considering that negotiation is above all a cost and a constraint.

“Narrow vision of social dialogue”

The mission of elected staff members has also become more difficult to assume, with a “Lengthening of meetings”, according to Berger. His point was illustrated by the testimony of several cédétistes activists, including Malika Poumbga, union representative in the Marionnaud chain of stores. Those who sit in the CSEs do not arrive “More to master all subjects”, she explained, invoking the ” lack of time “, “Of means” and the agendas become superabundant. The debates are more and more “Superficial”, carried out in the “Precipitation”, which generates ” pain “ among employee representatives.
