The councilors of Cipolletti have been debating for months the ordinance project that seeks to adhere to the National Law “Zero alcohol behind the wheel”. In the last session of the Deliberative Council this was unanimously approved and will come into effect in the next 20 days.
Since May, with regard to national routes, the Zero Alcohol Law was promulgated, but each province and municipality could continue to be governed by their own laws and ordinances within their ejido: that is, they could adhere but it is not mandatory.
On Friday, in the ordinary session of the Cipolletti Deliberative Council, the ordinance was finally approved “Zero alcohol at the wheel and modification to the Traffic Code”.
The initiative was presented by councilor Lorena Yensen, who stated that the initiative has two important aspects. I explain that one of them is the normative part and that the municipality of Cipolletti has been adhering to the transit regulations that tolerated 0.5 alcohol in the blood. He stated that this situation generated confusion because Neuquén has already approved the zero alcohol behind the wheel regulations, therefore, harmony must be sought and what corresponds is to equalize that situation.
The situation was as follows: if the driver must take a test on the side of the province of Neuquén, the breathalyzer control should give him 0.0 to avoid infractions. But in the case of being controlled by SRoad safety on the Río Negro side the limit is 0.2 milligrams of alcohol in blood, the equivalent of a glass of wine, and continue circulating. In cipolletti the ordinance was even more permissive, and drivers could drive their vehicles with up to 0.5 milligrams of alcohol in blood Inside the city.
Councilor Carlos Martinez Larrea said that this is a small step to raise awareness about the damage caused by alcohol, but that the ordinance does not address the problem in depth and asked that “This is not the only initiative that is taken into account.”
Larralde stressed that it is progress, but also pointed out that road safety problems are crossed by the infrastructure of the routes and that it is not in optimal conditions. LAfter the approval of this ordinance, it will take effect in the next 20 days.
What does the regulation establish?
the ordinance establishes adherence to National Law No. 27. 714 of «zero alcohol at the wheel that seeks to reduce the factors that increase the probability of occurrences of road accidents produced as a result of alcohol consumption.
Prohibit driving with physical or mental impediments in the entire Cipolletti ejidos. Likewise, it is prohibited to drive any type of vehicle with a blood alcohol level greater than zero milligrams per liter of blood.
Furthermore, it states that In case of determining the presence of alcohol in the blood, the police authority may order the immediate retention of the driver of which must be duly recorded in the minutes for this purpose to be drawn up. Likewise, the retention of the vehicle will be arranged until it can be driven by a capable person, free of risk.
