The director of a large obstetrics and gynecology clinic in Seongnam, Gyeonggi Province, sued former soccer player Lee Dong-guk (44) and his wife Lee Su-jin for attempted fraud. The obstetrics and gynecology department in question is the hospital where Lee Dong-guk and his wife’s twin daughters and youngest son were born, and Lee Dong-guk and his wife are engaged in a legal battle over the hospital being used to promote the hospital.
According to Incheon Yeonsu Police Station on the 21st, Mr. Kim, the director of Kwak Women’s Hospital in Seongnam, Gyeonggi Province, filed a complaint against Lee Dong-guk and his wife on charges of attempted fraud on the 15th.
Lee Dong-guk and his wife gave birth to twin daughters, Seol-ah and Su-a, at this hospital in July 2013. In November 2014, her youngest son, Sian, widely known as ‘Daebak’, was also born here.
On the website of the obstetrics and gynecology postpartum care center, promotional materials announcing the birth of Lee Dong-guk and his wife are posted. Lee Dong-guk and his wife, however, claim that they did not consent to their family’s photos being used to promote the hospital.
Lee Dong-guk and his wife filed a civil mediation request for damages against Director Kim in October 2022. Since the photos were taken without consent, they are demanding 1.2 billion won, equivalent to family modeling fees. It was reported that the infringement on portrait rights began in November 2013.
However, Director Kim’s side is said to be in the position that “Lee Dong-guk and his wife either actively agreed to using the birth of their child for hospital publicity purposes or expressed their consent in a tacit manner.” The court decided to dismiss the application for mediation, saying it did not meet the requirements for a lawsuit.
When the application for mediation was rejected, Mr. Kim filed a complaint against Lee Dong-guk and his wife to the police. He said that he took over this hospital and became its director in February 2019, but Lee Dong-guk and his wife filed an application for mediation with the court, including up to that point, which amounts to attempted fraud.
The police plan to summon the complainant, Mr. Kim, soon for questioning. A police official said, “We plan to investigate the complainant to determine whether a crime has been committed and then investigate Lee Dong-guk and his wife as necessary.”
