The Unresolved Mystery of the Palace of Justice: The Search for Truth and Identification of the Victims

On November 6, 1985, M-19 took over the Palace of Justice. A day later, the Colombian Public Force retook the building with blood and fire, leaving several people dead or missing.

The Absence of Recognition of Truth Section of the Special Jurisdiction for Peace (JEP) summoned Legal Medicine, and other State institutions, to a public hearing on November 14, 2023 to present a report on the current state of identification of the bodies recovered on the occasion of the events related to the seizure and retaking of the Palace of Justice.

In a 14-page document, the JEP stated that: “In order to guarantee access to information and the adequate participation of victims, it is advisable to call a public hearing so that the INMLCF can enlighten the judiciary and the victims of the Palace of Justice. on the scope of the report regarding the identification of bodies and bone structures recovered, on the occasion of the aforementioned events.”

In accordance with the Section of Absence of Recognition, at the hearing Legal Medicine must make a detailed and precise presentation of all the information that said entity has in relation to the various identification processes carried out on the occasion of the events at the Palace of Justice. , the requests for information made by both the aforementioned victims and the representation of the Public Ministry and, particularly, resolve various concerns.

The JEP says that after November 6 and 7, 1985, Legal Medicine managed to identify and deliver 56 bodies, while 38 bodies were subject to state burial in the South cemetery. “What happened to the 38 bodies that were allegedly subject to state burial? The report does not refer to them again. Were these bodies part of the bodies later found in a common grave in said cemetery? At some point was your identification and delivery to your relatives achieved? 12.2 According to the report, among the 56 bodies identified and delivered on dates close to the occurrence of the events, “preliminary information from the Prosecutor’s Office includes 07 bodies that were subjected to cremation or were relocated.” What additional information does the Institute have in relation to said actions of the Attorney General’s Office?” asks the JEP.

Another of the JEP’s questions is whether it was known what the “preliminary information” consisted of and who gave the order to cremate or relocate the human remains. The report indicates, indicates the document of this special justice, that November 2014 the CTI of the Prosecutor’s Office delivered to Forensic Medicine 92 boxes with bodies and bone structures recovered in 1998, in the common grave of the South cemetery. “Has it been established how many bodies the bone structures contained in the 92 boxes received by the Institute corresponded to?” questions the JEP.
