Top 10 Proposed Amendments in Moroccan Consumer Protection Law to Address Changes in Online Commerce Habits

The Secretariat of Government (SGG) has received a draft bill from the Ministry of Trade and Industry to amend and supplement Law 31.08 on consumer protection. This initiative aims to respond to changes in the consumption habits of Moroccans, largely influenced by the rise of online commerce. Here are the 10 main proposed amendments:

  1. Introduction of new definitions related to operators of e-commerce platforms, delivery, liquidation and deceptive commercial practices.
  2. Obligation for managers of e-commerce platforms to provide certain information to consumers.
  3. Extension of the provisions concerning delivery, initially applicable to contracts concluded at a distance, to all types of contracts.
  4. Distinction between different price reduction practices, such as discounts, liquidations and promotional offers, and clarification of the conditions, periods and durations applicable to each of them.
  5. Broadening of the definition of remuneration to include all possible forms related to the sale or provision of services for remuneration.
  6. Definition of a free loan as a loan repaid without interest or other charges.
  7. Provision for a text regulating consumer protection associations.
  8. Provision of administrative provisions and sanctions against any person seeking to hinder search operations or to commit offenses provided for in the aforementioned Law No. 31.08.
  9. Authorization of Bank Al-Maghrib agents to control the compliance of banking institutions and credit institutions with the requirements of this law.
  10. Inclusion of amendments regarding the creation of the Higher Consumer Advisory Council.
