Tragic Case of Fatal Dog Attack: Mother Sentenced and Controversy Over Fate of Second Mastiff

The fifteenth chamber of the Hainaut Court of Appeal, devoted to environmental offenses, delivered its judgment on Tuesday in the case of the mother of little Talya, bitten by her dogs on July 12, 2021 in La Louvière. The 8-year-old girl did not survive her injuries.

The defendant, who had left her daughter alone with her mastiffs for about twenty minutes, benefited from the suspension of the pronouncement of the sentence, last September, by the sixth chamber of the correctional court of Hainaut, division of Mons, where she was prosecuted for manslaughter through lack of foresight or precaution. The court had attached this preferential measure to conditions for a period of five years.

On appeal, the court overturned the judgment and sentenced the mother to a 12-month sentence, accompanied by a probationary suspension of 5 years. She can no longer keep any dogs and other pets.

The question of the fate of a dog was also raised in court. One of the two mastiffs had been shot by the police, but the second was collected by the SPA of La Louvière, which is protesting against his euthanasia. This dog had been confiscated by court order.

The court decides that the dog will be euthanized if returned to him.
