Transistor Ticket Refunds: Consumer Rights, Delays, and Corporate Controversies

2023-12-14 20:54:56

A complex situation affects more than 200 people who bought tickets for the concert Raw Alejandro in Chile, event by the production company Transistor which was going to take place on October 23 at the Hipódromo Chile. Weeks before the show, it was canceled by the artist, along with his entire Latin American tour.

At first, and after calling on the public to fill out a form, the ticket agent in charge of the show, FunTicketreported that the returns would be made “starting October 23 and for 30 days thereafter”with a “transfer for the total amount of the purchase.”

During this period, and in view of the delay and inactivity of payments, consumers organized themselves. Through a WhatsApp group they collected data and testimonies. Today, there are 228 who are still waiting for their payments, but weeks ago there were more than 300. The same community, these days, houses more than 500 users and adds new annoying consumers every day.

Natalia Escuderowho bought two pre-sale tickets to see the Puerto Rican in Chile, assumed the coordination of those affected. “We estimate that the debt is more than 45 million pesos taking into account the outstanding amounts”count to BioBioChile.

The situation, which is already in the hands of the National Consumer Service (Sernac) and the National Corporation of Consumers and Users (Conadecu), occurs on critical days for the production company, the same one behind the event Festival Frontera 2023 (rescheduled during the year) that today hangs by a thread.

Regarding the Sernac, the entity is collecting data and witnesses individually, case by case. As confirmed BioBioChileIn the next few days the government entity will inform the ticket company and the producer, “in order to determine possible actions to defend consumer rights”.

Almost a month after the expiration of the refund period established by the ticket company itself (whose legal representative is Leonardo Valeriafounding partner of Transistor), there is resignation from the consumer group: “There have been returns, but very few. There are weeks in which less than 20 are carried out, and others in which none are carried out”says Natalia.

“Every day someone asks: Have there been returns? We have nothing, not even a statement, and we see that they continue to hold events. They are going to bring Slash next year, now they have this thing about Frontera, on the verge of suspension. We stand idly by, we think we are going to lose. There are people who don’t need money, me for example. But there are others that do,” she emphasizes.

A production company, several corporate names and a history of scandals

Despite standing out as one of the most important producers in the country (they have brought artists of the caliber of Rihanna, Ennio Morricone, Primus, Morrisey, Ramnstein, Mike Patton, Sonic Youth y Snoop Doggamong others), those who attend concerts know that Transistor has a long “bad reputation.”

Since the remembered and eventful debut of the Festival Frontera in 2013 (and even before) until the recent events that marked the last Knot party(access and logistical problems inside the Monumental Stadium, especially at hydration points and public bathrooms), the local producer has been constantly questioned, so much so that its firm has disappeared from some of the events it announces (the last one festival version Ritual, For example).

In 2019, even a group of national artists, including La Pozze Latina, El Cruce and Mauricio Redolésthey reported million-dollar debts as a result of canceled shows in a report on the portal The Dynamo.

This week, a new milestone was added to the list. From the Chilean Society of Musical Authors and Performers (SCD), requested before the civil justice a precautionary measure as a result of the non-payment of copyrights that extends for almost 10 years, carried out through various social reasons (Soldout Chile Promotions, Ritual Chile Producer, Coliseo Producciones Limitada, etc.).

Natalia Escudero, who regularly participates in this type of event, was aware of the risk she ran when she saw the Transistor logo on her ticket to Rauw Alejandro.

“I found out when I received the tickets that Transistor was behind the concert… I knew they had problems, everyone knows it. I found out what happened at Knotfest and other events, like now Frontera. And when I review the comments that come to me, they all ask the same thing: Why is this production company still working?”he points out.

“I am helpless, first with myself, because we know that we may not receive anything. So what we are saying is don’t buy from this production company anymore, because the only way for this to end is for those involved to never have the possibility of creating a company like this again. But they are going to do them again and again.”

Transistor: his version of events

BioBioChile He contacted the production company Transistor -whose founder, it should be remembered, is the same legal representative of the Rauw Alejandro show ticket company-, in order to know their version of the events and clear up the doubts raised.

“As for money refunds, there is a small percentage that is still being resolved. We are talking about a total of around 20 thousand tickets sold, and we must have a universe of 500 or 300 left that have not yet been finalized for various reasons. This should be resolved in the next 7 days,” they point out to BioBioChile.

“Of the 20 thousand, money was instantly returned on about 15 thousand tickets. The other five thousand were delivered little by little, directly, and that took a lot of time,” he added.

According to the production company, the delays have been caused by problems related to the payment gateways. “This was done through FunTicket, but the payment platforms were different,” they added.

Asked about the relationship between FunTicket y Transistorfrom the production company they pointed out that it was the first (a Mexican affiliated company) that was in charge of the production of Rauw Alejando’s complete tour of Latin America.

“They were selling tickets. We were as partners, here in Santiago, and that is why the legal representation (of Leonardo Valeria). We had to be, like Transistor, related to the company FunTicket”he points out.

Will Valeria, then, leave the legal representation of FunTicket? From the production company, they warn: “It shouldn’t. “This was done for this show, specifically, it is not that an alliance was formed to work.”
