The 157 municipalities whose opinions were rejected include Athens and Astypalaia, a fact that causes a sensation given that the complaints of these municipalities about the excessive level at which the objective prices were set in their areas on 1-1-2022 were strong and had received a lot of publicity. The only option now available to the mayors or the residents of the 157 municipalities whose opinions were rejected is to appeal to the Council of State (Council of State) requesting the annulment of the ministerial decision which imposed increases in the objective prices of real estate in their areas. That is, they can follow the example of 7 other municipalities that in the past achieved the retroactive cancellation of increased objective values ​​in their areas. If the appeals are accepted, then the increased objective prices established on 1-1-2022 will be canceled and the Ministry of National Economy and Finance will be forced to restore them to the pre-2022 levels.

According to information from the Ministry of National Economy and Finance, out of a total of 169 municipalities in the country, which had submitted opinions in which they argued that the objective prices of real estate determined in 2022 in their territorial jurisdictions were too high, only 12 will benefit with reductions in the objective prices of their properties. These 12 municipalities are the following: Ag. Anargyron – Kamaterou, Vrilissi, Chalandrio, Glyfada, Piraeus, Ithaca, Karpathos, Loutraki – Perachora – Agios Theodoros, Symi, Pyrgos, Rhodes and Leros.

For these municipalities, a new process of readjustment of the objective zone values ​​will begin. In the coming days, his decision will be issued Minister of National Economy and Finance K. Hatzidakis which will define the process of price adjustment by assigning the project to the private appraisers certified by the ministry.

Benefits

It is noted that the new reduced prices that will be set will come into force from the date of issuance of the relevant ministerial decision and not retroactively from 1-1-2022. Therefore, the reductions in zone prices in the municipalities will not affect the amount of ENFIA for 2022, 2023 and 2024. The same rule will apply to the Real Estate Tax (TAT) imposed with the electricity bills in favor of municipalities and this is also calculated based on the objective zone prices of January 1 of each year. Thus, the effects on ENFIA and TAP will be felt in these municipalities from 2025. However, with regard to the taxes imposed on the acquisition of real estate, such as transfer, inheritance, donation and parental benefits taxes, the effects of the reductions in objective values zone will be direct to the specific municipalities, as they will cause reductions in the taxable values ​​of the properties from the date of entry into force of the relevant ministerial decisions.

The Minister of National Economy and Finance Mr. Kostis Hatzidakis, speaking on the show Society Hour MEGA, commented on the publication of ET and Eleftherostypos.gr which concerns the upheaval coming to objective values ​​and ENFIA.

“12 municipalities in one way or another brought evidence with which they attempt to refute the amount of objective values ​​as determined by the competent committee. The competent committee will review the objective values ​​for these 12 municipalities and reach whatever conclusions it reaches. I can’t announce anything. It is a matter for the experts to decide,” he said specifically.

Overall, the competent committee of the Ministry of National Economy and Finance, out of the total of 169 opinions submitted by the same number of municipalities, focused on the opinions of 14 municipalities, as only for them it was judged that there were valid indications – based on the data submitted – of the necessity of reviewing the objectives zone values. The other 2 municipalities were Mykonos and Astypalea. Out of the 14 opinions, the committee referred, with a positive recommendation, directly to a new adjustment procedure 8 – those submitted by the Municipalities of Ag. Anargyron – Kamaterou, Vrilissi, Chalandrio, Ithaki, Karpathos, Loutraki – Perachora – Agios Theodoros, Symi and Pyrgos. And this is because the accompanying evidence was deemed sufficient. For the other 6 opinions – of the Municipalities of Glyfada, Piraeus, Rhodes, Leros, Mykonos and Astypalaia – the committee requested additional information. However, 4 of the 6 municipalities responded to this invitation, specifically the municipalities of Glyfada, Piraeus, Rhodes and Leros. Thus, these 4 municipalities “passed” with a positive recommendation in the review phase. The other 2 municipalities that did not respond, Mykonos and Astypalea, saw their opinions rejected.

Thus, a total of 157 municipalities out of the 169 that submitted opinions were not justified by the ministry’s committee. Of these, 155 were not satisfied because it was initially judged that they did not support their claims with full and sufficient evidence and the other 2 we mentioned above, because they did not send all the information requested of them. Among the 155 municipalities, whose opinions were rejected due to the lack of documented evidence supporting the necessity of reducing the objective prices, was the Municipality of Athens, which had been quick to be the first to challenge the ministerial decision of 2022 on the adjustment of the objective prices prices. The 155 that were not finally justified by the committee of the Ministry of National Economy and Finance also include the following municipalities:

* From Attica: Moschato, Tavros, Marousi, Heraklion, Petroupoli, Elliniko, Kallithea, Ag. Dimitrios, Zografou, Rafina, Pallini, Haidari, Dafni and Ag. Barbara.

The only way out is to appeal to the Supreme Court

The only way of reaction now left to the 157 municipalities whose opinions were rejected is for them or their citizens to appeal to the Council of State (Council of State) requesting the annulment of the ministerial decision which increased the objective prices of real estate in their areas from on 1-1-2022. If there are municipalities or citizens who will appeal and if the appeals are accepted by the CoE, then the Ministry of National Economy and Finance will be obliged to reduce the objective prices in the areas of these municipalities retroactively from 1-1-2022 with effects on the revenues from property taxes. The path of appeal to the SC had been followed in the past by citizens of the Municipalities of Psychiko – Filothei, Ekali, Athens, Agia Varvara, Delphi and Tinos, for specific areas of these municipalities. The appeals were accepted in 2020 by the CoE, consequently in all areas where the CoE canceled the increased objective prices, the ministry was forced to accept a retroactive reduction of dozens of taxes imposed on the possession and acquisition of real estate, such as FAP, ENFIA , the TAP and the taxes on transfers, donations, parental benefits and inheritances.
