The marital crisis between Chiara Ferragni and Fedez seems to have reached a point of no return. Gassani is keen to underline a point that applies to the influencer and the rapper, but also to many Italian families, even if they are not in the midst of a separation. “The law is clear”, to publish photos of minor children “you need the consent of both but the advice of a matrimonial lawyer is that you should never publish photos online with or without consent, as has been happening in France for a few months “, says Gassani. In short, the consent of both spouses is a “false problem”, the real issue is the right of children not to be exposed on social media.

“One day the children could ask for compensation for damages” from both parents, explains the lawyer, and “secondly the judge could order the deletion of previous photos”. Gassani then sends a message to viewers: “You must not publish photos of children under the age of 14, ever.” The host Giuseppe Brindisi makes “self-criticism” on behalf of all those who post images of their children and asks if we should “delete past photos too”. The lawyer responds with the example of Ferragnez: “They should do it if the judge were to order it. We have article 10 of the civil code and we have law 196/2003 updated to 2023 which speak clearly, there are even three years of imprisonment” , says Gassani. In short, it is better not to expose your children to social media.
