Zbigniew Ziobro is still on leave. The committees want to appoint experts

Despite reports appearing in the public space that the state of the leader of Sovereign Poland was an escape from accountability for his public activities in recent years, politicians of the parliamentary majority are distanced from them.

– It’s risky, because if the commission summons him and he doesn’t want to appear, maybe they will extend his deadline once, but the third time they will appoint an expert who will examine him and decide whether he can testify or not – he tells Newsweek ” one of the leaders of the coalition party. — It’s true that I hear voices that there is some kind of arrangement in Lublin at this hospital, but in the current situation such a hospital director wouldn’t risk it either. These are stories that may even cost you contracts with the National Health Fund.

Indeed, politicians from the investigative committee investigating the use of Pegasus have announced from the very beginning that they intend to interrogate Ziobro. The commission for organizing envelope elections is also considering summoning Ziobro. Already in Jarosław Gowin’s testimony, a thread of pressure appeared, to which the former Minister of Justice was not to succumb. The former deputy prime minister testified that Ziobro informed him that there were demands to collect hooks on him. He was supposed to refuse. Now two prosecutors will appear before the commission and, after their testimony, the commission will decide whether there is anything to talk about with the former minister.

– I’ll have no choice. If we summon him, I emphasize “if”, and he sends an exemption, I will have to ask the prosecutor’s office to appoint an expert who will determine whether the witness can be questioned and under what conditions – explains Dariusz Joński, head of the commission for envelope elections. — We can even commission the hearing to the prosecutor so that the witness is not forced to talk to the entire commission. We have such opportunities.

When asked about this on Radio “Zet”, Patryk Jaki replied that “it was probably done this way in Stalinist times. It is clear that such habits are still present on the left, where there are many people from communist times. (…) We voted I am in favor of the minister being interrogated, but only when he is healthy and when he has strength.

This was done, but not entirely in Stalinist times, because such an option is provided by the Code of Civil Procedure amended by PiS. In Article 263 we read: “A witness who cannot appear on the summons due to illness, disability or other obstacle that cannot be removed, is questioned at his place of stay. Roman Giertych, among others, was questioned in the hospital and the prosecutor’s office had no doubts at that time that acts in accordance with the law.

There are also politicians from the parliamentary majority who say outright that they do not believe in the illness of the leader of Sovereign Poland. The greatest doubts are raised by the fact that the Lublin Region Oncology Center is being treated, where the director is prof. Elżbieta Starosławska. Prof. she was a provincial consultant and hospital director until 2016, when she lost her job. The charges against her concerned corruption cases. The voivodeship marshal, who supervises the hospital, found that prof. Starosławska violated the Anti-Corruption Act as well as the Public Procurement Act. She worked for a company that won tenders in her hospital to supply drugs to the hospital pharmacy. The total value of these orders was PLN 16 million. According to the then voivodeship marshal, prof. should have excluded itself from tender proceedings, which it did not do. Prof. argued that her mandate contracts did not require exclusion from tender procedures. The case was brought to the regional prosecutor’s office in Lublin, considered one of Zbigniew Ziobro’s most loyal offices. Prosecutor Jerzy Ziarkiewicz, who kept the files of some cases in the garage that were not very favorable to the then government, decided that there was no case and discontinued it. Prof. She regained her job and Przemysław Czarnek reappointed her to the position of provincial consultant, declaring that for him the matter had been resolved. She also returned to the position of director of the Oncology Center, although it was said then that the voivodeship marshal was not enthusiastic about this return, but succumbed to pressure from the very top of PiS. All these relationships that have been going on for several years make some people have many questions.

– The basic question is who has what for whom and what – says one of our interlocutors from the Civic Coalition.

The leader of Sovereign Poland disappeared from public life shortly after the elections. He last appeared in the Sejm on November 15, when he delivered a very emotional speech on the occasion of the election of new members of the National Council of the Judiciary.

– I warn you. After night there is day. The time will come when you will find yourself in opposition. Come on, Mr [zwrócił się do Borysa Budki — red.] he won’t be so sure. Time flies quickly. I hope you won’t turn out to be losers – the then Minister of Justice shouted from the podium. He heard from the then opposition benches: “You will be in jail.”
