A judge investigates a Vox deputy for building a swimming pool in a municipal green area | Spain

The Investigative Court number 1 of Martos (Jaén) is investigating the Vox deputy Francisco José Alcaraz for an alleged illegal construction in a green area owned by the Jaén City Council of Torredonjimeno. The judicial investigation, in the preliminary proceedings phase, is a consequence of the complaint filed by the Provincial Prosecutor’s Office for the Environment and Urban Planning, which considers that there are indications of the commission of two crimes of usurpation of real estate and against the planning of the territory, which The Penal Code punishes with sentences of up to two and four years in prison, respectively.

The judge has given the ultra parliamentarian and former president of the Association of Victims of Terrorism (AVT) a period of 15 days to deliver all the documentation related to his properties on the plots under investigation and “allow access to his properties in order to to carry out an inspection visit”; warning him that “any resistance, obstruction, excuse or refusal to inspection actions is considered a serious infraction.” It so happens that Alcaraz has already obstructed a first inspection of his home by municipal technicians.

The investigation opened by the Prosecutor’s Office, following a complaint from an individual, concluded that Francisco José Alcaraz and several of his direct relatives have allegedly appropriated a plot of 3,854 square meters owned by the Torredonjimeno City Council (Jaén), classified as an area green, and have proceeded “to divide and parcel it into three lots or subplots, without indicating the existence of a license or authorization.”

On two of these municipal subplots, adjacent to those inherited by the Alcaraz family from their father, illegal buildings and constructions were carried out, according to the Nature Protection Service (Seprona) of the Civil Guard. In one of them, Alcaraz’s sister built a 30 square meter metal structure in 2018; while in the other the Vox deputy himself built a 20 square meter pool in 2007, to which in 2018 he added a 45 meter covered porch and buildings and warehouses with a metal structure for another 45 meters; in addition to, already in 2019, a warehouse. “The buildings and facilities mentioned, carried out without a planning license, are not legalizable,” according to the Prosecutor’s Office.

After visiting Alcaraz’s home, the municipal architect of Torredonjimeno stated in a report that the deputy “posed impediments to the inspection, and it could not be carried out in optimal conditions, so it was decided to leave the place.” It so happens that one of the crimes that the Prosecutor’s Office allegedly attributes to Alcaraz, that of occupation of property, is one of those that the ultra party wants to punish most harshly. The Public Ministry has complained about the lack of collaboration of the new mayor of the town of Jaén, where Alcaraz has his home, the popular Enrique Castro, who after the elections in May last year replaced the socialist Manuel Anguita as head of the council.

He made the leap into politics with Vox in January 2019, first as a regional senator for Andalusia and then as a deputy.
